There was also another alleged assault victim, but the boy was not found guilty. He is on supervised probation until he turns 18 at a locked juvenile treatment center.<\/p>\n<p>Brooks ruled to drop the boy from the registry in a Thursday hearing. Commonwealth Attorney Buta Biberaj, who said prior that the boy was released from jail due to having no \u201chistory\u201d of assault, argued that putting him on the registration was for the community\u2019s safety and wellbeing. Biberaj was elected in 2019 after receiving $850,000 from a political action committee funded by left-wing billionaire George Soros.<\/p>\n<p>\u201cI can\u2019t rest on it being immaturity,\u201d Biberaj said in a discussion about the boy\u2019s status as a minor, requesting he remain on the registry until the age of 30.<\/p>\n<p>The attorneys defending the boy, William Mann, Jonathan Moore, and Caleb Kershner \u2014 who sits on the Loudoun County Board of Supervisors \u2014 pushed the narrative that the boy was a victim. Kershner said he is the center of \u201ca national media outcry\u201d and that this has resulted in the high level of scrutiny.<\/p>\n<p>\u201cWe are setting him up for failure,\u201d Kershner claimed in his closing remarks. \u201cWe\u2019ve never concentrated on [the boy] \u2014 we\u2019re not even giving this young man a chance.\u201d The board member also said the 15-year-old has been \u201ccheated\u201d by the \u201cfailure of the system.\u201d<\/p>\n<p>Scott Smith, the father of the victim raped at Stone Bridge High School, believes it is his family that has been wronged by the system. He released a statement after the hearing describing how he and his wife are \u201cheartbroken\u201d and \u201cmad at how the justice system and the Loudoun County Commonwealth\u2019s attorney has let down [his] daughter, as well as the other victims of his predatory actions.\u201d<\/p>\n<p>\u201cThe person who committed these horrible crimes against these three young women will not have to bear the shame at being known as a lifetime registered sex offender, as he was originally sentenced,\u201d said Smith. \u201cRather, we are now concerned more than ever that this change in his legal status may put other parents\u2019 daughters at risk of harm in the future.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\">Statement from the Scott Smith family after Loudoun County Juvenile Court Judge Pamela Brooks changed her decision to place the convicted 15 year old on Virginia\u2019s Adult Sex Offender list. LCPS launched an internal probe after Miyares announced his own.
