Dick Durbin (D-IL) of Supreme Court Justice Stephen Breyer\u2019s alleged retirement plan before CNBC first broke the news.<\/p>\n<p>While Klain has been <a href=\"https:\/\/twitter.com\/redsteeze\/status\/1486435687578492928?s=20\">accused<\/a> of pushing&nbsp;Breyer from his position on the Court, CNN reported that Durbin was <a href=\"https:\/\/twitter.com\/mkraju\/status\/1486747343672291329?s=20\">notified<\/a> by Klain of Breyer\u2019s departure around 9:30 a.m. before the news broke.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Breyer reportedly <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/01\/26\/report-justice-breyer-upset-retirement-plan-leaked\/\">characterized<\/a> the news of his departure as making him feel \u201cupset,\u201d \u201csurprised,\u201d and \u201ccaught off guard.\u201d<\/p>\n<p>During the 9:30 a.m. phone call between Durbin and Klain, Durbin reportedly asked if a nominee to replace Breyer was selected.<\/p>\n<p>\u201cWe\u2019re in the process,\u201d Klain reportedly responded.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Well no, Ron Klain did. <a href=\"https:\/\/t.co\/VnWhlwq2lz\">https:\/\/t.co\/VnWhlwq2lz<\/a><\/p>\n<p>\u2014 Stephen L. Miller (@redsteeze) <a href=\"https:\/\/twitter.com\/redsteeze\/status\/1486435687578492928?ref_src=twsrc%5Etfw\">January 26, 2022<\/a><\/p>\n<\/blockquote>\n<p>Durbin replied the Senate confirmation hearing\u2019s timetable was unknown. \u201cIt\u2019s little early to predict a timetable for this hearing,\u201d Durbin reportedly said.<\/p>\n<p>Durbin is the chairman of the Senate Judiciary Committee and is in charge of holding hearings on Biden\u2019s nominee to replace Breyer.<\/p>\n<p>Before the news&nbsp;<a href=\"https:\/\/www.cnbc.com\/2022\/01\/26\/supreme-court-justice-stephen-breyer-to-retire-giving-biden-a-chance-to-nominate-a-replacement.html\">broke<\/a>&nbsp;midmorning by CNBC, Biden, the White House, Breyer, and the Supreme Court had not put out a statement about Breyer\u2019s retirement.<\/p>\n<p>However, after the news broke, White House press secretary Jen Psaki immediately <a href=\"https:\/\/twitter.com\/PressSec\/status\/1486384652256522242?s=20\">stated<\/a> it was Breyer\u2019s decision to announce his retirement:<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote>\n<p><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">It has always been the decision of any Supreme Court Justice if and when they decide to retire, and how they want to announce it, and that remains the case today.
