The 83-year-old <a href=\"https:\/\/dailycaller.com\/2022\/01\/26\/justice-stephen-breyer-retire-supreme-court\/\">justice<\/a> is the second-longest serving current member, and his retirement will take effect at the start of summer recess as long his successor has been decided on and approved.<\/p>\n<p>\u201cOur process is going to be rigorous,\u201d the president said on selecting Breyer\u2019s successor. \u201cI will select the nominee worthy of Justice Breyer\u2019s legacy of excellence and decency. While I\u2019ve been studying candidates\u2019 backgrounds and writings, I\u2019ve made no decision except one.\u201d<\/p>\n<p>\u201cThe person I will nominate will be someone of extraordinary qualifications, character, experience and integrity,\u201d the president continued. \u201cAnd that person will be the first black woman ever nominated to the United States Supreme Court. It\u2019s long overdue, in my opinion.\u201d<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n<p>Biden said he has not yet made a decision, but promised one by the end of February. <a href=\"https:\/\/dailycaller.com\/2020\/10\/16\/joe-biden-court-packing-question-campaign-co-chairman-cedric-richmond\/\"><strong>(RELATED: Biden \u2018Has Not Dodged\u2019 Court Packing Question, Just \u2018Not Going To Answer,\u2019 Says Campaign Co-Chairman)<\/strong><\/a><\/p>\n<p>The president noted in 2020 that he was already putting together a list of qualified black women \u2013 vowing at the time to nominate a black woman should he have the opportunity to do so \u2013 but declined to release it prior to a vetting process.<\/p>\n<p>\u201cI will listen carefully to all the advice I\u2019m given, and I\u2019ll study the records and former cases carefully,\u201d the president said, noting that he plans to invite senators from both parties in addition to Vice President <a href=\"https:\/\/dailycaller.com\/2022\/01\/26\/laurence-tribe-biden-harris-supreme-court-breyer\/\">Kamala Harris<\/a> for the review process.<\/p>\n<p>\u201cIn the end, I will nominate a historic candidate, someone who is worthy of Justice Breyer\u2019s legacy, and someone who, like Justice Breyer, will provide incredible service on the United States Supreme Court,\u201d Biden said.<\/p>\n<p>While news of Breyer\u2019s retirement plans broke Wednesday, the Justice formally announced his plan to retire in a <a href=\"https:\/\/www.nytimes.com\/live\/2022\/01\/27\/us\/stephen-breyer-supreme-court-retire\">letter<\/a> to the president Thursday.
