On Wednesday, the White House confirmed that President Joe Biden would be <a href=\"https:\/\/www.dailywire.com\/news\/psaki-refuses-to-answer-if-kamala-harris-being-considered-for-supreme-court-biden-reiterated-his-commitment-to-nominating-a-black-woman\">committed to nominating<\/a> a Supreme Court justice using a race-based admission practice and would be choosing a black woman for the court to replace the outgoing justice, Stephen Breyer.<\/p>\n<p>Both announcements center around the choosing of a candidate or nominee based on immutable characteristics to determine their qualifications. This juxtaposition was not lost on conservatives who sounded the alarm on Biden\u2019s race-based nominee process. For example, The Daily Wire\u2019s Matt Walsh pointed out Biden\u2019s decision is most likely \u201ccompletely illegal.\u201d<\/p>\n<p>\u201cIt\u2019s actually completely illegal for a government official to specifically exclude certain races when hiring someone for a position,\u201d Walsh tweeted. \u201cIt\u2019s illegal in about ten different ways in fact. Not that any of that matters to Biden or the Left of course.<\/p>\n<p>\u2014 Matt Walsh (@MattWalshBlog) <a href=\"https:\/\/twitter.com\/MattWalshBlog\/status\/1486425325001232390?ref_src=twsrc%5Etfw\">January 26, 2022<\/a><\/p>\n<p>Indeed, George Washington University Professor Jonathan Turley <a href=\"https:\/\/thehill.com\/opinion\/judiciary\/487961-did-biden-realize-his-discriminatory-pledge-for-his-supreme-court-pick\">wrote in 2020<\/a> that Biden\u2019s campaign pledge \u2014 now presidential pledge \u2014 was patently discriminatory and entirely similar to outlawed affirmative action practices:<\/p>\n<p><em>Imposing an absolute requirement that a nominee be a particular gender and race is effectively an affirmative action pledge. It is precisely what the Supreme Court already declared to be unconstitutional discrimination. In the 1977 case of Regents of the University of California versus Allan Bakke, the Supreme Court found quota and affirmative action admissions policies based on race to be unconstitutional. While the justices were fractured on the logic, a clear plurality on the bench supported the view that preferring \u201cmembers of any one group for no reason other than race or ethnic origin is discrimination for its own sake,\u201d adding \u201cthis the Constitution forbids.\u201d<\/em><\/p>\n<p>The Daily Wire reached out to Alex Deise, an attorney and policy manager at FreedomWorks, to get his take on the matter.<\/p>\n<p>\u201cWhen Joe Biden\u2019s presidential campaign was struggling, he promised the voters that he would nominate a black woman if there was a vacancy on the Supreme Court,\u201d Deise explained. \u201cInstead of considering merit, qualifications, background, experience, judicial temperament or quality of writing, Biden thought the candidate should be picked solely on the basis of immutable characteristics.\u201d<\/p>\n<p>\u201cIn that way, it seems quite fitting that the Biden Administration will likely find itself in the Supreme Court arguing in favor of Harvard and the University of North Carolina as they defend their race-based admissions policies, the same policies Biden has employed here,\u201d Deise continued.<\/p>\n<p>SCOTUS Blog <a href=\"https:\/\/www.scotusblog.com\/2022\/01\/court-will-hear-challenges-to-affirmative-action-at-harvard-and-university-of-north-carolina\/\">reported<\/a> that the Supreme Court would hear a case that has the potential to outlaw higher education using race-based admission, even to craft a \u201cdiverse\u201d student body:<\/p>\n<p><em>The Supreme Court on Monday agreed to reconsider the role of race in college admissions. In a brief&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/012422zor_m6io.pdf\">order<\/a>, the justices agreed to take up two cases asking them to overrule their landmark 2003 decision in&nbsp;<a href=\"https:\/\/casetext.com\/case\/grutter-v-bollinger-et-al\">Grutter v. Bollinger<\/a>, holding that the University of Michigan could consider race as part of its efforts to assemble a diverse student body. The decision to grant review in the two new cases suggests that the court\u2019s conservative majority is poised to do just that.<\/em><\/p>\n<p>On Monday, Deise <a href=\"https:\/\/www.dailywire.com\/news\/attorney-supreme-court-has-historic-opportunity-to-end-race-based-college-admissions?%3Futm_source=twitter&amp;utm_medium=social&amp;utm_campaign=dwtwitter\">told<\/a> The Daily Wire that with these two cases, \u201cthe Supreme Court has a historic opportunity to eliminate the ability of colleges and universities to explicitly discriminate on the basis of race in their admissions process.\u201d<\/p>\n<p>In the past, Justice Clarence Thomas has deemed such practices as \u201cracial engineering\u201d that has \u201cinsidious consequences\u201d for all involved.<\/p>\n<p>\u201cThere can be no doubt that the University\u2019s discrimination injures white and Asian applicants who are denied admission because of their race,\u201d Thomas said in 2012 regarding the University of Texas\u2019 use of race in college applications. \u201cBut I believe the injury to those admitted under the University\u2019s discriminatory admissions program is even more harmful.\u201d<\/p>\n<p>Regardless of whom Biden chooses, Deise affirmed Thomas\u2019s view of race neutrality and advocated the new justice adopt Thomas\u2019 posturing.<\/p>\n<p>\u201cHopefully, whoever President Biden nominates to the Court will take the bold and courageous stand that Justice Thomas has, and conclude that the use of race in the college admissions process is unconstitutional because it violates the Equal Protection Clause\u2019s core tenet of race neutrality,\u201d Deise said.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
