White House press secretary Jen Psaki <a href=\"https:\/\/twitter.com\/Forbes\/status\/1376950628786790400\">affirmed<\/a> that position in March 2021, and number three Senate Democrat Patty Murray of Washington said Wednesday she looks forward to Biden\u2019s nominee \u201cbreak[ing] barriers and mak[ing] history as the first Black woman on the Supreme Court of the United States.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Sen. Patty Murray, No. 3 Democrat in the chamber: \u201cI am ready to move as quickly as possible to consider and confirm a highly qualified nominee who will break barriers and make history as the first Black woman on the Supreme Court of the United States.\u201d<\/p>\n<p>\u2014 Sahil Kapur (@sahilkapur) <a href=\"https:\/\/twitter.com\/sahilkapur\/status\/1486395934808367114?ref_src=twsrc%5Etfw\">January 26, 2022<\/a><\/p>\n<\/blockquote>\n<p>Biden has several options to choose from in order to fulfill his campaign pledge, although Vice President Kamala Harris will most likely not be one of them. Nominating Harris to the Court would allow Biden to replace one of the one of the <a href=\"https:\/\/dailycaller.com\/2021\/07\/21\/poll-morning-consult-politico-kamala-harris-favorable-approval\/\">least<\/a> popular vice <a href=\"https:\/\/dailycaller.com\/2021\/11\/18\/kamala-harris-communications-director-ashley-etienne-resigns\/\">presidents<\/a> in modern <a href=\"https:\/\/dailycaller.com\/2021\/11\/08\/joe-biden-poll-kamala-harris-november-38-28-percent\/\">history<\/a>, and President Barack Obama reportedly <a href=\"https:\/\/www.latimes.com\/politics\/la-pol-ca-kamala-harris-supreme-court-20160216-story.html\">considered<\/a> nominating her after the 2016 death of Antonin Scalia.<\/p>\n<p>However, Psaki threw cold water on this strategy during her Wednesday press conference, telling Fox News\u2019 Peter Doocy that Biden has \u201cevery intention of running for re-election with Vice President Harris on the ticket.\u201d <a href=\"https:\/\/dailycaller.com\/2022\/01\/26\/justice-stephen-breyer-retire-supreme-court\/\"><strong>(RELATED: REPORT: Justice Stephen Breyer To Retire)<\/strong><\/a><\/p>\n<p>Here are three of the most likely candidates:<\/p>\n<p><strong>Ketanji Brown Jackson<\/strong><\/p>\n<p>Brown Jackson is likely the favorite to receive the nomination and was already <a href=\"https:\/\/dailycaller.com\/2021\/06\/14\/supreme-court-dc-circuit-merrick-garland\/\">confirmed<\/a> by the current Senate in June to the U.S. Court of Appeals for the D.C. Circuit. Three Republicans, Susan Collins of Maine, Lisa Murkowski of Alaska and Lindsey Graham of South Carolina, joined with all 50 Democrats to support her appeals court nomination. The D.C. Circuit is considered to be a stepping stone to the Supreme Court, with current Justices John Roberts, Clarence Thomas, and Brett Kavanaugh sitting on it immediately prior to their confirmations.<\/p>\n<p>If confirmed, Brown Jackson would also be Breyer\u2019s first former <a href=\"https:\/\/www.fjc.gov\/history\/judges\/jackson-ketanji-brown\">clerk<\/a> to sit on the Supreme Court, as well as the first former defense attorney to sit on the Court since Thurgood Marshall retired in 1991.<\/p>\n<p>As a District Court judge, Brown Jackson ruled against the Trump administration in several cases. She <a href=\"https:\/\/dailycaller.com\/2018\/08\/25\/judge-trump-unions\/\">rejected<\/a> a series of executive order President Donald Trump issued in 2018 that would have limited the power of public sector unions and <a href=\"https:\/\/dailycaller.com\/2019\/12\/23\/doj-mcgahn-subpoena-dc-circuit\/\">upheld<\/a> a 2019 subpoena issued to then-White House counsel Don McGahn by the House Judiciary Committee. Brown Jackson also <a href=\"https:\/\/dailycaller.com\/2019\/09\/30\/judges-block-trump-immigration-agenda\/\">blocked<\/a> the Trump administration\u2019s expedited removal process for illegal immigrants.<\/p>\n<p>Her <a href=\"https:\/\/dailycaller.com\/2019\/07\/16\/trump-government-unions-ruling\/\">rulings<\/a> on the unions and on illegal <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/d-c-circuit-panel-slams-district-court-injunction-against-expedited-removal\/\">immigration<\/a> were later overruled by appeals courts, while her stance on the McGahn subpoena was <a href=\"https:\/\/dailycaller.com\/2021\/06\/04\/don-mcgahn-testifying-house-judiciary-committee-subpoena-battle\/\">upheld<\/a>.<\/p>\n<div id=\"attachment_7359940\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7359940\" class=\"wp-caption-text\">WASHINGTON, DC \u2013 APRIL 28: Ketanji Brown Jackson, nominated to be a U.S. Circuit Judge for the District of Columbia Circuit, testifies before a Senate Judiciary Committee hearing on pending judicial nominations on Capitol Hill, April 28, 2021 in Washington, DC. (Photo by Kevin Lamarque-Pool\/Getty Images)<\/p>\n<\/div>\n<p><strong>Leondra Kruger<\/strong><\/p>\n<p>Kruger currently sits as an associate justice on the California state Supreme Court, where she is <a href=\"https:\/\/www.latimes.com\/politics\/story\/2020-04-02\/biden-says-he-will-put-a-black-woman-on-supreme-court-this-california-justice-is-a-leading-candidate\">considered<\/a> a moderate on criminal justice issues. She clerked for Associate Supreme Court Justice John Paul Stevens and <a href=\"https:\/\/www.latimes.com\/local\/politics\/la-me-supreme-court-nominee-20141125-story.html\">served<\/a> in multiple positions in the Justice Department during the Obama administration.<\/p>\n<p>She would be a favorite of Obama administration alumni, with former Solicitor General Donald Verrilli Jr. praising her as \u201ca superb choice.\u201d<\/p>\n<p>\u201cShe has a powerful intellect and she\u2019s a careful thinker. She is not rigidly ideological, but fair, open-minded and prudent. And those are the qualities you want in a justice of the Supreme Court,\u201d he said in April 2020.<\/p>\n<p><strong>J. Michelle Childs<\/strong><\/p>\n<p>Childs currently sits on the U.S. District Court for South Carolina, although Biden <a href=\"https:\/\/www.ali.org\/news\/articles\/j-michelle-childs-nominated-dc-circuit\/\">nominated<\/a> her to the D.C. Circuit Court of Appeals in December. Childs\u2019 background in labor law makes her attractive to some activists.
