He called Breyer\u2019s retirement \u201cthe only responsible choice.\u201d&nbsp;<\/p>\n<p>\u201cDemocratic Rep. Mondaire Jones on Friday said Supreme Court Justice Stephen Breyer should retire this summer, becoming the first congressional member to publicly call for the 82-year-old justice to step down,\u201d <a href=\"https:\/\/web.archive.org\/web\/20210418025000\/https:\/\/www.cnn.com\/2021\/04\/16\/politics\/mondaire-jones-stephen-breyer-supreme-court\/index.html\">CNN<\/a> reported that same month.&nbsp;<\/p>\n<p>\u201cThere\u2019s no question that Justice Breyer, for whom I have great respect, should retire at the end of this term,\u201d Jones <a href=\"https:\/\/web.archive.org\/web\/20210418025000\/https:\/\/twitter.com\/jiveDurkey\/status\/1383076388010348546\">said<\/a> when asked whether Breyer should retire before the end of Biden\u2019s presidency.<\/p>\n<p>As NBC News explained, \u201cProf. Erwin Chemerinsky, dean of the law school at the University of California at Berkeley, wrote in a Washington Post op-ed in May urging Breyer to retire that there are times \u2018when the stewards of our system must put the good of an institution they love, and of the country they love, above their own interests. They have to recognize that no one, not even a brilliant justice, is irreplaceable, and that the risks presented by remaining are more than hypothetical.&#8217;\u201d<\/p>\n<p>In August, 2021, Justice Breyer admitted that he would likely retire at some stage.<\/p>\n<p>\u201cThere are many things that go into a retirement decision,\u201d he told <a href=\"https:\/\/www.nytimes.com\/2021\/08\/27\/us\/politics\/justice-breyer-supreme-court-retirement.html\">The New York Times<\/a>.<\/p>\n<p>\u201cHe said, \u2018I don\u2019t want somebody appointed who will just reverse everything I\u2019ve done for the last 25 years,\u2019\u201d Justice Breyer said of a conversation with Justice Antonin Scalia on the subject of retirement. \u201cThat will inevitably be in the psychology\u201d of his decision, he added.<\/p>\n<p>\u201cI don\u2019t think I\u2019m going to stay there till I die \u2014 hope not,\u201d Justice Breyer explained.<\/p>\n<p>\u201cThere are a lot of blurred things there, and there are many considerations,\u201d he said of a retirement decision. \u201cThey form a whole.
