However, Judge Lawrence VanDyke \u2014 <a href=\"https:\/\/d3n8a8pro7vhmx.cloudfront.net\/firearmspolicycoalition\/pages\/5604\/attachments\/original\/1642706843\/McDougall_v_Ventura_County_Opinion.pdf?1642706843\">writing<\/a> on behalf of a three-judge panel for the 9th U.S. Circuit Court of Appeals \u2014 explained that the policies limited \u201cthe right of the people to keep and bear arms,\u201d since the Second Amendment \u201cmeans nothing if the government can prohibit all persons from acquiring any firearm or ammunition.\u201d<\/p>\n<p>\u201cUnder California\u2019s highly regulated framework for firearms, law-abiding citizens can only obtain firearms and ammunition by arriving in-person to government-approved gun and ammunition shops,\u201d he wrote. \u201cThese blanket prohibitions on access and practice clearly burden conduct protected by the Second Amendment and fail under both strict and intermediate scrutiny.\u201d<\/p>\n<p>\u201cThe governments\u2019 designation of \u2018essential\u2019 businesses and activities reflects a government-imposed devaluation of Second Amendment conduct in relation to various other non-Constitutionally protected activities during times of crises, irrespective of any of the unique dangers presented by firearms, ammunition, or firing ranges,\u201d VanDyke added.<\/p>\n<p>The <a href=\"https:\/\/www.nraila.org\/articles\/20220120\/nra-wins-case-against-los-angeles-county\">National Rifle Association<\/a> (NRA) lauded the ruling.<\/p>\n<p>\u201cThe court today rightfully recognized that Los Angeles County violated Second Amendment rights when it shut down gun stores and ranges in the beginning of the COVID-19 pandemic,\u201d said NRA office of litigation counsel director Michael Jean. \u201cThis is an important decision. It ensures that California \u2014 or any state \u2014 cannot use a crisis to trample on the Constitutional rights of citizens.\u201d<\/p>\n<p>Beyond the Second Amendment, Los Angeles County cracked down on First Amendment rights through its lockdown policies \u2014 namely, by stopping church communities from meeting together. However, Pastor John MacArthur\u2019s Grace Community Church eventually defied the regulations, meeting for Sunday worship without social distancing or mandatory masking.<\/p>\n<p>\u201cIn response to the recent state order requiring churches in California to limit or suspend all meetings indefinitely,\u201d MacArthur <a href=\"https:\/\/www.gracechurch.org\/news\/posts\/1988\">wrote<\/a> in the summer of 2020, \u201cwe, the pastors and elders of Grace Community Church, respectfully inform our civic leaders that they have exceeded their legitimate jurisdiction, and faithfulness to Christ prohibits us from observing the restrictions they want to impose on our corporate worship services.\u201d<\/p>\n<p>In the fall of 2021, Grace Community Church <a href=\"https:\/\/www.dailywire.com\/news\/l-a-county-to-pay-400000-to-john-macarthurs-grace-community-church\">won<\/a> a $400,000 settlement from Los Angeles County following the Supreme Court\u2019s ruling that some COVID-19 regulations could not apply to houses of worship. The state of California paid the church $400,000 as well, bringing the total to $800,000.<\/p>\n<p>\u201cWe know that there is no circumstance that can cause the church to close,\u201d MacArthur said in a letter. \u201cThe church is not only a building but is the bride of Christ and exists to proclaim the truth.\u201d<\/p>\n<p>\u201cWe are very pleased to see Pastor MacArthur and Grace Community Church\u2019s First Amendment protections fully vindicated in this case,\u201d said Jenna Ellis and Charles LiMandri of the Thomas More Society, which represented Grace Community Church.
