Both Harvard and UNC have been sued over apparent discrimination against Asian and white Americans.<\/p>\n<p>\u201cIn Harvard\u2019s case, a lawsuit \u2013 brought by a group called Students for Fair Admissions (SFFA) \u2013 alleged that the university unfairly weighs race when considering applicants, forcing Asian-American students to meet a higher bar than their peers from other racial groups,\u201d the BBC <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-60116884\">reported<\/a> Monday. \u201cA separate lawsuit filed by the SFFA against the University of North Carolina (UNC) alleged that white applicants were being discriminated against in an admissions process that favoured black, Hispanic, and Native American applicants.\u201d<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Both schools have denied unlawful admissions processes.<\/p>\n<p>Author Carrie Severino reacted to the news Monday, noting of Justice Clarence Thomas\u2019 past concurrence with the court against affirmative action processes. \u201cGreat to see the Court taking these cases and, to quote Justice Thomas, addressing the \u2018insidious consequences\u2019 of \u2018racial engineering,&#8217;\u201d she wrote.<\/p>\n<p lang=\"en\" dir=\"ltr\">Great to see the Court taking these cases and, to quote Justice Thomas, addressing the &#8220;insidious consequences&#8221; of &#8220;racial engineering.&#8221; <a href=\"https:\/\/t.co\/i1FbUdr6yG\">https:\/\/t.co\/i1FbUdr6yG<\/a><\/p>\n<p>\u2014 Carrie Severino (@JCNSeverino) <a href=\"https:\/\/twitter.com\/JCNSeverino\/status\/1485630117611245575?ref_src=twsrc%5Etfw\">January 24, 2022<\/a><\/p>\n<p>Back in 2012, Thomas, who is black,&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/012422zor_m6io.pdf\">wrote<\/a> that affirmative action processes hurt all Americans, including the minorities the policies are intending to help.<\/p>\n<p>\u201cI note that racial engineering does in fact have insidious consequences,\u201d Thomas wrote, concerning a&nbsp;challenge to an affirmative action program at the University of Texas. \u201cThere can be no doubt that the University\u2019s discrimination injures white and Asian applicants who are denied admission because of their race. But I believe the injury to those admitted under the University\u2019s discriminatory admissions program is even more harmful.\u201d<\/p>\n<p>\u201cBlacks and Hispanics admitted to the University as a result of racial discrimination are, on average, far less prepared than their white and Asian classmates,\u201d Thomas said.<\/p>\n<p>\u201cThe University admits minorities who otherwise would have attended less selective colleges where they would have been more evenly matched,\u201d he argued. \u201cBut, as a result of the mismatching, many blacks and Hispanics who likely would have excelled at less elite schools are placed in a position where underperformance is all but inevitable because they are less academically prepared than the white and Asian students with whom they must compete. Setting aside the damage wreaked upon the self- confidence of these overmatched students, there is no evidence that they learn more at the University than they would have learned at other schools for which they were better prepared.
