Opening statements could take place as soon as Monday, following jury selection,\u201d <a href=\"https:\/\/www.reuters.com\/world\/us\/sarah-palin-set-battle-new-york-times-defamation-trial-2022-01-23\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a> noted in an earlier report. \u201cPalin bears the&nbsp;high burden of showing by clear and convincing evidence that there was \u2018actual malice\u2019 involved in the newspaper\u2019s editorial writing process.\u201d<\/p>\n<p>Palin sued the publication over allegations of being defamed in 2017 by an editorial that linked a political action committee ad to a 2011 shooting that included serious injuries to then-Arizona Democratic Rep. Gabby Giffords and killed six others.<\/p>\n<p>\u201cAt issue is the elasticity of the protections that allow news organizations to present tough coverage of public figures,\u201d <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2022\/01\/21\/sarah-palin-v-nyt-exploring-line-between-bad-journalism-libelous-journalism\/\" target=\"_blank\" rel=\"noopener\">The Washington Post<\/a> reported on Friday.<\/p>\n<p>\u201cOr, to put things a bit more sharply, the case will help demarcate the line between really bad journalism and libelous journalism,\u201d the report added.<\/p>\n<p>\u201cIt has been 58 years since the Supreme Court adopted the \u2018actual malice\u2019 standard in the landmark decision <em>New York Times v. Sullivan,<\/em> making it difficult for public figures to win libel suits,\u201d <a href=\"https:\/\/www.axios.com\/sarah-palin-defamation-new-york-times-83401a07-f967-48b5-ba6b-1898986a8122.html\" target=\"_blank\" rel=\"noopener\">Axios<\/a> reported on Sunday.<\/p>\n<p>\u201cTwo current justices, conservatives Clarence Thomas and Neil Gorsuch, have suggested revisiting that standard. Palin has signaled in court papers she\u2019ll challenge <em>Sullivan<\/em> on appeal if she loses at trial,\u201d Axios added.<\/p>\n<p><a href=\"https:\/\/www.dailywire.com\/news\/sarah-palin-libel-case-versus-the-new-york-times-heads-to-jury-trial-this-month\" target=\"_blank\" rel=\"noopener\">The Daily Wire<\/a> previously reported regarding Palin\u2019s case against the Times heading to court:<\/p>\n<p><em>U.S. District Court Judge Jed Rakoff on Tuesday set January 24 as the selection date for jurors in the case to be set in Manhattan, according to&nbsp;<a href=\"https:\/\/www.hollywoodreporter.com\/business\/business-news\/new-york-times-sarah-palin-trial-1235073229\/\" target=\"_blank\" rel=\"noopener\">The Hollywood Reporter<\/a>.<\/em><\/p>\n<p><em>\u201cPalin is represented by a legal team led by Shane Vogt at Bajo Cuva Cohen Turkel while The New York Times is being handled by a team including David A. Schulz at Ballard Spahr,\u201d according to the report.<\/em><\/p>\n<p><em>\u201cThe initial version of&nbsp;<a href=\"https:\/\/www.nytimes.com\/2017\/06\/14\/opinion\/steve-scalise-congress-shot-alexandria-virginia.html\" target=\"_blank\" rel=\"noopener\" aria-label=\"the 2017 Times editorial (opens in a new window)\">the 2017 Times editorial<\/a>&nbsp;said it was \u2018clear\u2019 that the 2011 shooting was linked to a map Palin\u2019s political action committee released that included crosshairs over Giffords\u2019 Tucson district. However, no such link has ever been established. The shooter \u2026 was found to be mentally ill and was sentenced to life in prison in 2012,\u201d&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2020\/08\/29\/sarah-palin-libel-new-york-times-404810\" target=\"_blank\" rel=\"noopener\">Politico<\/a>&nbsp;reported in 2020.<\/em><\/p>\n<p><em>The Times later corrected the wording, but Palin pursued the legal suit, claiming the outlet should be held responsible for the false claim.<\/em><\/p>\n<p><em>The case was originally turned down in 2017.
