According to the&nbsp;<em>Fortnite&nbsp;<\/em>developer, \u201cApple\u2019s conduct is precisely what the antitrust laws prohibit.\u201d<\/p>\n<p>The Verge <a href=\"https:\/\/www.theverge.com\/2022\/1\/20\/22893546\/epic-apple-fortnite-appeal-app-store-restrictions\">reports<\/a>&nbsp;that Epic has filed a brief in the Ninth Circuit Court of Appeal aiming to overturn a previous ruling which stated that tech giant Apple was not engaging in monopolistic behavior by retaining control over its iOS App Store. The filing states:<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<blockquote>\n<p>Epic proved at trial that Apple restrains trade\u2026by contractually requiring developers to exclusively use Apple\u2019s App Store to distribute apps and Apple\u2019s IAP for payments for digital content within apps.<\/p>\n<p>If not overturned, [the district court] decision would upend established principles of antitrust law and\u2026undermine sound antitrust policy.<\/p>\n<\/blockquote>\n<p>In September, Epic\u2019s attempts to challenge Apple\u2019s App Store restrictions came to an end when a district court <a href=\"https:\/\/www.breitbart.com\/tech\/2021\/09\/13\/fortnite-developer-epic-games-wins-legal-battle-royale-over-apple\/\">ordered<\/a> Apple to remove certain restrictions on in-app payments but otherwise ruled that the company had not engaged in other anti-competitive practices. (Photo by Sarah Stier\/Getty Images)<\/p>\n<\/div>\n<p>Judge Gonzales Rogers was quite ambiguous over whether or not Apple held monopoly power over the mobile gaming market in her ruling, stating:&nbsp;\u201cThe evidence does suggest that Apple is near the precipice of substantial market power, or monopoly power, with its considerable market share. Apple is only saved by the fact that its share is not higher, that competitors from related submarkets are making inroads into the mobile gaming submarket, and, perhaps, because [Epic] did not focus on this topic.\u201d<\/p>\n<p>In the appeals brief, Epic is attempting to draw a clearer link between the iPhone\u2019s success in the mobile gaming industry and possible monopolistic behavior.&nbsp;\u201cThe district court\u2019s factual findings make clear,\u201d the filing alleges, \u201cthat Apple\u2019s conduct is precisely what the antitrust laws prohibit.\u201d<\/p>\n<p>Apple said in a statement on the appeal:&nbsp;\u201cIn its ruling last year, the district court confirmed that Apple is not a monopolist in any relevant market and that its agreements with app developers are legal under antitrust laws.
