The city has no role in enforcing this abortion ban, so it cannot be sued by those who oppose the ordinance.<\/p>\n<\/blockquote>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/righttolifeofeasttexas\/posts\/4681196168622721\" data-width=\"640\">\n<blockquote cite=\"https:\/\/graph.facebook.com\/251862594889456\/posts\/4681196168622721\/\" class=\"fb-xfbml-parse-ignore\">\n<p>&#8220;Planned Parenthood Abandons Legal Challenge to Lubbock&#8217;s Abortion Ban at the U.S. 5th Circuit Court of Appeals.&#8221;FOR\u2026<\/p>\n<p>Posted by <a href=\"https:\/\/www.facebook.com\/251862594889456\">Right to Life of East Texas<\/a> on&nbsp;<a href=\"https:\/\/graph.facebook.com\/251862594889456\/posts\/4681196168622721\/\">Friday, January 21, 2022<\/a><\/p>\n<\/blockquote>\n<\/div>\n<p>As Breitbart News reported in September 2020, Lubbock\u2019s mayor and city council&nbsp;<a href=\"https:\/\/www.breitbart.com\/politics\/2020\/09\/09\/lubbock-texas-weighs-ordinance-outlawing-abortion-within-city-limits\/\">considered<\/a>&nbsp;the ordinance after sufficient signatures were gathered by Lubbock citizens to allow for a city council vote. The council ultimately voted 7-0 against the ordinance, reasoning that the Supreme Court\u2019s 1973 decision in&nbsp;<em>Roe v. Wade<\/em>&nbsp;is considered by many to be the \u201claw of the land.\u201d<\/p>\n<p>Subsequently, however, the Initiative and Referendum process allowed for Lubbock residents to place the ordinance on the ballot and to vote on it themselves on May 1, 2021.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Lubbock Mayor Dan Pope said in a statement at that time that \u201cvoters made it clear that Lubbock will become the next sanctuary city for the unborn.\u201d<\/p>\n<div id=\"attachment_19584434\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/01\/GettyImages-1344464989.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-19584434\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/01\/GettyImages-1344464989.jpg\" alt=\"President &amp; CEO at Planned Parenthood of Greater Texas, Inc. (Amy Sussman\/Getty Images)<\/em><\/p>\n<\/div>\n<p>Planned Parenthood had <a href=\"https:\/\/www.everythinglubbock.com\/news\/abortions-started-this-month-at-planned-parenthood-in-lubbock\/\">begun<\/a> performing abortions at its Lubbock facility on April 15, 2021. As a result, the Lubbock abortion ban ordinance made the city the first in the nation to outlaw abortions after they were already being performed.<\/p>\n<p>The Lubbock ordinance contains two \u201cenforcement mechanisms,\u201d one public and one private, Dickson <a href=\"https:\/\/www.liveaction.org\/news\/texas-lubbock-city-largest-us-outlaw-abortion\/\">wrote<\/a> at Live Action News on May 2, 2021.<\/p>\n<p>\u201cWhile the public enforcement mechanism is dependent upon the overturning of&nbsp;<em>Roe v. Wade<\/em>,&nbsp;the private enforcement mechanism is immediately enforceable,\u201d he noted.<\/p>\n<p>The Lubbock ordinance private enforcement mechanism states:<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote>\n<p>Any person, corporation, or entity that commits an unlawful act \u2026 other than the mother of the unborn child that has been aborted, shall be liable in tort to the unborn child\u2019s mother, father, grandparents, siblings and half-siblings. The person or entity that committed the unlawful act shall be liable to each surviving relative of the aborted unborn child for: (a) Compensatory damages, including damages for emotional distress; (b) Punitive damages; and (c) Costs and attorneys\u2019 fees.<\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Pro-Life Victory!  <\/p>\n<p>In a major and historic victory for the right to life, Planned Parenthood is dropping its lawsuit over the city of Lubbock\u2019s abortion ban, ensuring that the ordinance will remain in effect! <a href=\"https:\/\/twitter.com\/hashtag\/txlege?src=hash&amp;ref_src=twsrc%5Etfw\">#txlege<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/prolife?src=hash&amp;ref_src=twsrc%5Etfw\">#prolife<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/sanctuarycityfortheunborn?src=hash&amp;ref_src=twsrc%5Etfw\">#sanctuarycityfortheunborn<\/a> <a href=\"https:\/\/t.co\/SrGsx1GlTD\">pic.twitter.com\/SrGsx1GlTD<\/a><\/p>\n<p>\u2014 Dustin Burrows (@Burrows4TX) <a href=\"https:\/\/twitter.com\/Burrows4TX\/status\/1484525243620278273?ref_src=twsrc%5Etfw\">January 21, 2022<\/a><\/p>\n<\/blockquote>\n<p>When Planned Parenthood of Greater Texas and the American Civil Liberties Union (ACLU) filed a federal lawsuit against the city of Lubbock, claiming the ordinance was unconstitutional, Dickson <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/05\/19\/planned-parenthood-aclu-file-lawsuit-to-block-lubbock-texas-ordinance-outlawing-abortion\/\">wrote<\/a> on Facebook the lawsuit \u201cis frivolous.\u201d<\/p>\n<p>\u201cThe federal courts have no ability to prevent private litigants from suing abortion providers under a duly enacted law, and there is nothing a federal court can do to stop private citizens from suing to enforce this ordinance,\u201d he asserted, adding the abortion ban in Lubbock \u201cwill take effect on June 1st, regardless of what happens in this lawsuit, and any person who aids or abets an abortion in Lubbock will be facing immediate lawsuits.\u201d<\/p>\n<p>A federal district court <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/06\/02\/court-dismisses-planned-parenthoods-lawsuit-against-lubbock-texas\/\">dismissed<\/a> Planned Parenthood\u2019s lawsuit for lack of jurisdiction. Planned Parenthood appealed that ruling but announced on Thursday that it was dropping its appeal and ending its litigation over the ordinance.<\/p>\n<p>Right to Life East Texas\u2019 Facebook post noted the Lubbock ordinance\u2019s similarity to the Texas Heartbeat Act, which the U.S. Supreme Court has <a href=\"https:\/\/www.breitbart.com\/politics\/2022\/01\/20\/supreme-court-refuses-block-texas-abortion-law\/\">allowed<\/a> to stand as any lawsuits that&nbsp;<a href=\"https:\/\/www.breitbart.com\/faith\/2022\/01\/18\/abortion-clinics-fear-setback-as-suit-against-heartbeat-act-moves-to-texas-supreme-court\/\">continue<\/a> against it will now be heard by the Supreme Court of Texas:<\/p>\n<blockquote>\n<p>The Lubbock ordinance marks the first time that an abortion ban has survived court challenge in the United States since <em>Roe v. Wade<\/em>.<\/p>\n<p>The ordinance is structured in a manner similar to the Texas Heartbeat Act, which outlaws abortion after a fetal heartbeat is detectable but prohibits state officials from enforcing the law, instead authorizing private citizens to sue those who perform or aid or abet illegal abortions. By adopting this unique private-enforcement scheme, the city of Lubbock made its ordinance immune from pre-enforcement lawsuits because neither the city nor its officials have any role in enforcing the law, so they cannot be subjected to lawsuits that challenge the constitutionality of the ordinance.<\/p>\n<\/blockquote>\n<p>\u201cI congratulate the City and the people of Lubbock on this historic victory\u2014and for becoming the first jurisdiction in the United States to successfully defend an abortion ban in court since <em>Roe v. Wade<\/em>,\u201d <a href=\"https:\/\/www.everythinglubbock.com\/news\/local-news\/appeal-dropped-planned-parenthood-vs-lubbock-comes-to-an-end\/\">said<\/a> state Sen. Charles Perry (R) of Lubbock, a supporter of the ordinance, as reported by Everything Lubbock. \u201cThis is an answer to so many of our prayers.\u201d<\/p>\n<p>\u201cWe have said from the beginning that the abortion bans we have drafted are bulletproof from court challenge, and we are pleased that the litigation over Lubbock\u2019s ordinance has proven us right,\u201d Dickson said in his Facebook post. \u201cWe will continue our work to enact similar ordinances in other cities throughout the United States.\u201d<\/p>\n<p>The case is&nbsp;<em><a href=\"https:\/\/www.scribd.com\/document\/508266264\/Planned-Parenthood-files-lawsuit-against-City-of-Lubbock-on-abortion-ordinance#from_embed\">Planned Parenthood of Greater Texas Surgical Health Services v.
