The letter specifically said that Trump was under criminal investigation for his conduct during the call, a state official familiar with the letter told <a href=\"https:\/\/www.nytimes.com\/2021\/02\/10\/us\/politics\/trump-georgia-investigation.html?referringSource=articleShare\">The New York Times<\/a>.<\/p>\n<p>Willis considered launching a criminal investigation into the former president for weeks after the full audio of Trump\u2019s phone call with Raffensperger was leaked to the press. Former prosecutors told The New York Times what the Fulton County investigators may be looking for in the Jan. 2 phone call:<\/p>\n<blockquote>\n<p><em>Former prosecutors said Mr. Trump\u2019s calls might run afoul of at least three state laws. One is criminal solicitation to commit election fraud, which can be either a felony or a misdemeanor; as a felony, it is punishable by at least a year in prison. There is also a related conspiracy charge, which can be prosecuted either as a misdemeanor or a felony. A third law, a misdemeanor offense, bars \u201cintentional interference\u201d with another person\u2019s \u201cperformance of election duties.\u201d<\/em><\/p>\n<\/blockquote>\n<p>News of the criminal investigation follows a Monday decision by Raffensperger\u2019s office to open an <a href=\"https:\/\/www.dailywire.com\/news\/georgia-officials-open-investigation-into-trumps-call-with-brad-raffensperger\">administrative investigation<\/a> into Trump over the phone call. The investigation was prompted by a complaint by George Washington University law professor John Banzhaf III.<\/p>\n<p>\u201cThe secretary of state\u2019s office investigates complaints it receives. The investigations are fact-finding and administrative in nature. Any further legal efforts will be left to the attorney general,\u201d Raffensperger\u2019s office said in a statement.<\/p>\n<p>During the Jan. 2 phone call, Trump insisted that he had won Georgia\u2019s election if all legal votes were tallied and claimed he had evidence to show that Georgia election officials were wrong in their official count. As <a href=\"https:\/\/www.dailywire.com\/news\/washington-post-reports-trump-pressured-georgia-secretary-of-state-to-find-votes\">The Daily Wire<\/a> reported:<\/p>\n<blockquote>\n<p><em>On the recording, Trump appears to insist that he won the state by an overwhelming majority, and asks Raffensperger to \u201crecalculate\u201d the vote count.<\/em><\/p>\n<p><em>\u201cI just want to find 11,780 votes,\u201d Trump says, though from the conversation it appears he believes those votes were \u201cstolen\u201d in incidents of election fraud, not that he believes Raffensperger could manufacture the votes out of thin air.<\/em><\/p>\n<p><em>\u201cAll I want to do is this: I just want to find 11,780 votes, which is one more than we have, because we won the state,\u201d Trump states. \u201cFlipping the state is a great testament to our country; it\u2019s a testament that they can admit to a mistake. A lot of people think it wasn\u2019t a mistake, it was much more criminal than that. But it\u2019s a big problem in Georgia and it\u2019s not a problem that\u2019s going away.\u201d<\/em><\/p>\n<p><em>Trump goes on to say that there is \u201cno way I lost Georgia. There\u2019s no way. We won by hundreds of thousands of votes,\u201d and that Raffensperger should \u201cbe careful of the political corruption\u201d in places like Fulton County, where he claims ballots were \u201cshredded\u201d and where he suggests that voting machine manufacturer Dominion \u201cis moving fast to get rid of their machinery.\u201d<\/em><\/p>\n<p><em>Dominion has repeatedly denied any involvement in a widespread conspiracy to subvert the outcome of the 2020 presidential election in November.<\/em><\/p>\n<\/blockquote>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
