(Photo by Sergio Flores\/Getty Images)<\/p>\n<\/div>\n<p class=\"css-axufdj evys1bk0\">\u201cToday, for the fourth time, this court declines to protect pregnant Texans from egregious violations of their constitutional rights,\u201d she added.<\/p>\n<p class=\"css-axufdj evys1bk0\">As <a href=\"https:\/\/www.nytimes.com\/2022\/01\/20\/us\/politics\/texas-abortion-law-supreme-court.html\">noted<\/a> by the <em>New York Times<\/em>, the ruling follows \u201ca decision last month <a class=\"css-1g7m0tk\" title=\"\" href=\"https:\/\/www.nytimes.com\/2021\/12\/10\/us\/politics\/texas-abortion-supreme-court.html\">allowing<\/a> the providers to sue at least some state officials to try to block or limit the law.\u201d<\/p>\n<p class=\"css-axufdj evys1bk0\">\u201cThat victory was an empty one, the dissenting justices wrote on Thursday, because the United States Court of Appeals for the Fifth Circuit, in New Orleans, refused to return the case to the trial judge and instead sent it on a legal detour to a state court,\u201d noted the <em>Times<\/em>.<\/p>\n<p class=\"css-axufdj evys1bk0\">The pro-life organization Texas Right to Life <a href=\"https:\/\/texasrighttolife.com\/texas-heartbeat-act-lawsuit-to-stay-in-supreme-court-of-texas\/\">celebrated<\/a> the decision on Thursday, hailing it as another opportunity to save preborn lives:<\/p>\n<blockquote>\n<p class=\"css-axufdj evys1bk0\">Today, the Supreme Court of the United States denied the abortion industry\u2019s desperate request to return&nbsp;<em>Whole Woman\u2019s Health v. Jackson<\/em>\u2014the lawsuit challenging the Texas Heartbeat Act\u2014back to a federal district judge proven to be hostile to the law.<\/p>\n<p>Last month, the Supreme Court&nbsp;<a href=\"https:\/\/texasrighttolife.com\/texas-heartbeat-act-remains-in-effect-supreme-court-sends-lawsuit-back-to-lower-court\/\">ruled<\/a>&nbsp;that certain state licensing officials might have indirect authority to enforce some aspects of the Texas Heartbeat Act, and thus the lawsuit may only proceed against them. The U.S. Court of Appeals for the Fifth Circuit recognized this question as a matter of state law, therefore&nbsp;<a href=\"https:\/\/texasrighttolife.com\/abortion-industry-desperate-per-new-hearing-in-texas-heartbeat-act-lawsuit\/\">certifying<\/a> the Supreme Court of Texas&nbsp;to determine to what extent these officials may enforce the Texas Heartbeat Act.<\/p>\n<p>Simply put: The Fifth Circuit is correct, and the abortion industry is wrong. (Photo by OLIVIER DOULIERY\/AFP via Getty Images)<\/p>\n<\/div>\n<p>\u201cOnce again the Supreme Court has betrayed the people of Texas, who have been callously stripped of their constitutional right to abortion for more than four months now,\u201d Planned Parenthood CEO Alexis McGill Johnson <a href=\"https:\/\/www.foxnews.com\/politics\/supreme-court-texas-ruling-january\">said<\/a> in a press release.<\/p>\n<p>\u201cBy enabling the state\u2019s obvious ploy to delay any resolution to this case, this Court is complicit in the widespread harm to Texans who remain unable to make meaningful decisions about their own bodies,\u201d she continued.<\/p>\n<p>A separate case out of Mississippi \u2013 <em>Dobbs v. Jackson<\/em> \u2013 could further decide the fate of <em>Roe v. Wade<\/em>&nbsp;as the justices decide if the state\u2019s abortion ban after 15 weeks violates the undue burden test of <em>Planned Parenthood v. Casey<\/em>.<\/p>\n<p>\u201cThe current mode of evaluation is an&nbsp;<em>undue burden test<\/em>&nbsp;tethered to a&nbsp;<em>viability line<\/em>: Pro-Life laws that impose an undue burden on a mother before a child can survive outside of the womb are considered constitutionally invalid.
