Any prosecution that fails to convict Trump risks becoming a disaster and could vindicate Trump, just as the inconclusive report by former special counsel Robert Mueller\u2019s team was seized upon by Trump and his allies to declare his exoneration on a separate series of allegations.\u201d<\/p>\n<p>The publication cited several senators whom it talked to, including Sens. Richard Blumenthal (D-CT), Tim Kaine (D-VA), and Sherrod Brown (D-OH).<\/p>\n<p>Blumenthal claimed that \u201cclearly what [Trump] did\u201d leading up to the riot \u201cfalls in the ambit of what\u2019s being investigated and perhaps is criminal.\u201d<\/p>\n<p>\u201cThey have all of the evidence at their disposal,\u201d Kaine said, later adding, \u201cMy sense is they\u2019re looking [at] everything in a diligent way and they haven\u2019t made a decision.\u201d<\/p>\n<p>Kaine said that he thinks there were \u201cfederal statutes that are very much implicated\u201d by what happened, although he did not name any.<\/p>\n<p>Brown said, \u201cI think anybody who it\u2019s proven had a role in the planning of [the Jan. 6 attack] should be prosecuted, not just the people who broke in and smashed the window in my office and others.\u201d<\/p>\n<p>\u201cI think anybody that\u2019s shown to have had a role in its planning absolutely should be prosecuted,\u201d Brown claimed. \u201cI mean it was treason, it was trying to overturn an election through violent means.\u201d<\/p>\n<p>The report highlighted recent remarks from Garland, who said, \u201cThe Justice Department remains committed to holding all Jan. 6 perpetrators, at any level, accountable under law \u2014 whether they were present that day or were otherwise criminally responsible.\u201d<\/p>\n<p>One Democrat Senator, who wished to remain anonymous, warned that if the Biden Justice Department pursued criminal charges against Trump that all it would take is one pro-Trump juror to derail a conviction, which could then blow up in the administration\u2019s face, especially if Trump were to run again in 2024.<\/p>\n<p>\u201cIf you pull the trigger on this one, you have to make sure that you don\u2019t miss, because this is one if you miss it essentially validates the conduct,\u201d the senator said.<\/p>\n<p>The report comes as New York Attorney General Letitia James <a href=\"https:\/\/www.nytimes.com\/2022\/01\/18\/nyregion\/trump-organization-fraud-letitia-james.html\">claimed<\/a> in court filings on Tuesday night that the Trump Organization engaged in \u201cfraudulent or misleading\u201d practices.<\/p>\n<p>James claimed in a statement: \u201cWe have uncovered significant evidence that suggests Donald J.
