It also gives preference to people who are older or have underlying conditions that increase their risk for severe COVID-19, but it switched to a scoring system that no longer considers race.<\/p>\n<p>State leaders had been planning revisions because of the scarcity of monoclonal antibodies that was exacerbated last month when providers stopped using two of three versions because they weren\u2019t effective against the omicron variant.<\/p>\n<\/blockquote>\n<p>The policy change happened the same day a conservative advocacy group, America First Legal (AFL), threatened to sue the state and Utah, claiming their racial preference policies appeared unfair:<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/americafirstlegal\/posts\/257130936531633\" data-width=\"640\">\n<blockquote cite=\"https:\/\/graph.facebook.com\/104253615152700\/posts\/257130936531633\/\" class=\"fb-xfbml-parse-ignore\">\n<p>The health departments in Utah and Minnesota could face potential discrimination lawsuits after they issued guidance\u2026<\/p>\n<p>Posted by <a href=\"https:\/\/www.facebook.com\/104253615152700\">America First Legal<\/a> on&nbsp;<a href=\"https:\/\/graph.facebook.com\/104253615152700\/posts\/257130936531633\/\">Thursday, January 13, 2022<\/a><\/p>\n<\/blockquote>\n<\/div>\n<p>Letters recently sent by AFL <a href=\"https:\/\/www.foxnews.com\/politics\/utah-minnesota-race-covid\">alleged<\/a> the states broke federal law through \u201cblatant discrimination,\u201d Fox News reported Thursday.<\/p>\n<p>\u201cA document dated Wednesday shows Minnesota citing federal guidance from the Food and Drug Administration stating that race and ethnicity were relevant factors,\u201d the outlet said.<\/p>\n<p>As of Monday, in a section titled \u201cWhat allocation decisions should not consider or be based upon,\u201d the document <a href=\"https:\/\/www.health.state.mn.us\/diseases\/coronavirus\/hcp\/mabethical.pdf\">cited<\/a>&nbsp;read:<\/p>\n<blockquote>\n<p>Race; ethnicity; gender; gender identity; sexual orientation or preference; religion; citizenship or immigration status; or socioeconomic status (this does not limit consideration of factors that data indicate are associated with heightened risks of progression to severe COVID-19 when assessing individual patient prognosis).<\/p>\n<\/blockquote>\n<p>Minnesota\u2019s rationing directions have changed more than once, the <em>Tribune<\/em> report said, adding,&nbsp;\u201cIn July, the Food and Drug Administration considered it ethically appropriate to prioritize racial minorities for antibody infusions.\u201d<\/p>\n<p>However, the Minnesota Department of Health in a recent statement did not offer insight into the timing or reason for the change but said it was reviewing policies to make sure&nbsp;\u201cthat communities that have been disproportionately impacted by COVID-19 have the support and resources they need.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Minnesota removed race as a factor for deciding which coronavirus patients receive monoclonal antibody treatments, the Star Tribune reported Thursday.
