A victory could impact all government employees and also change the way courts consider religious freedom. <a href=\"https:\/\/t.co\/kYgl5SZ7pS\">pic.twitter.com\/kYgl5SZ7pS<\/a><\/p>\n<p>\u2014 First Liberty Institute (@1stLiberty) <a href=\"https:\/\/twitter.com\/1stLiberty\/status\/1482135192441610242?ref_src=twsrc%5Etfw\">January 14, 2022<\/a><\/p>\n<p>\u201cBy taking this important case, the Supreme Court can protect the right of every American to engage in private religious expression, including praying in public, without fear of punishment,\u201d he added.<\/p>\n<p>Paul Clement, former U.S. Solicitor General, partner at Kirkland &amp; Ellis LLP and First Liberty volunteer attorney, said, \u201cWe look forward to presenting the Coach\u2019s case, which goes to the heart of the First Amendment, to the Justices.\u201d<\/p>\n<p>Joe Kennedy\u2019s case, now six years after the events, has led to renewed optimism by the coach who still desires to return to the football sidelines.<\/p>\n<p>\u201cSix years away from the football field has been far too long. I am extremely grateful that the Supreme Court is going to hear my case and pray that I will soon be able to be back on the field coaching the game and players I love,\u201d Kennedy said in the statement.<\/p>\n<p>Not everyone was pleased with the decision. American United for Separation of Church and State released a <a href=\"https:\/\/www.au.org\/media\/press-releases\/Bremerton-SCOTUS-Cert-Grant\" target=\"_blank\" rel=\"noopener\">statement<\/a> on Friday opposing the Supreme Court\u2019s announcement.<\/p>\n<p>\u201cNo child attending public school should have to pray to play school sports. No student should ever be made to feel excluded \u2013 whether it\u2019s in the classroom or on the football field \u2013 because they don\u2019t share the religious beliefs of their coaches, teachers or fellow students,\u201d Americans United President and CEO Rachel Laser said.<\/p>\n<p>\u201cThe Bremerton School District followed the law and protected students\u2019 religious freedom when it stopped its football coach from holding coercive prayers with players on the 50-yard line after high school football games,\u201d Laser added. \u201cPublic schoolchildren and their families \u2013 like all of us \u2013 have a constitutional right to believe as they choose and be treated equally by their public schools, regardless of their beliefs. The Bremerton School District fulfilled its legal duty to respect their fundamental rights.<\/p>\n<p>The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-declines-take-case-high-school-ashe-schow\" target=\"_blank\" rel=\"noopener\">reported<\/a> on Kennedy\u2019s case when it was turned down in 2019:<\/p>\n<p><em>Kennedy was hired by Bremerton High School (BHS) in 2008 and fired in 2015, with a contract that \u201centrusted\u201d him \u201cto be a coach, mentor and role model for the student athletes,\u201d according to court documents. He was expected to \u201cexhibit sportsmanlike conduct at all times\u201d and informed him that, as coach, he was \u201cconstantly being observed by others.\u201d<\/em><\/p>\n<p><em>Kennedy also led prayers with the team before and after games, but court documents note the tradition predated his employment and that his religion didn\u2019t require him to lead such prayers, but did require him to give thanks after each game.<\/em><\/p>\n<p><em>As Kennedy kneeled and prayed after each game, members of the team began to join him until a majority of the team was also praying. Members of the opposing team were also invited to join. Kennedy eventually began giving mid-field motivational speeches after the games that included religious messaging.<\/em><\/p>\n<p><em>On September 17, 2015, Bremerton School District (BSD) sent Kennedy a letter saying he would be investigated for breaking the school\u2019s policy on \u201cReligious-Related Activities and Practices,\u201d which stated that students may \u201cengage in private, non-disruptive prayer at any time not in conflict with learning activities\u201d and \u201c[s]chool staff shall neither encourage nor discourage a student from engaging in non-disruptive oral or silent prayer or any other form of devotional activity.\u201d<\/em><\/p>\n<p><em>Kennedy cooperated with the investigation and was told by BSD Superintendent that his prayers after the game were \u201cproblematic,\u201d and that he must stop including religious content in his motivational speeches.
