And it\u2019s much easier to do than to convict a president. So once those impeachment indictments are established, the speaker takes them over and hands them to the Senate,\u201d Hanson, senior fellow at the Stanford University-based think tank Hoover Institution told The Epoch Times\u2019 \u201c<a href=\"https:\/\/www.theepochtimes.com\/exclusive-victor-davis-hanson-on-the-2020-election-and-trumps-prospects_3578774.html?utm_source=morningbriefnoe&amp;utm_medium=email&amp;utm_campaign=mb-2020-11-15\">American Thought Leaders<\/a>.\u201d<\/p>\n<p>\u201cAnd then that becomes the trial, like a modern trial, and that requires a two-thirds majority, 66 senators to convict a president, something we\u2019ve never done. And we\u2019re not going to do it. We didn\u2019t do it in January of 2020. And we\u2019re not going to do it in February of 2021. And that\u2019s known in advance.<\/p>\n<p>\u201cSo that tells you that this is performance art, it\u2019s not a serious attempt to either remove Donald Trump during his tenure, or to ban him from office in his retirement,\u201d Hanson said.<\/p>\n<p>\u201cIt\u2019s like a public shaming like the Communist Party used to make people wear <a href=\"https:\/\/www.theepochtimes.com\/commentary-4-on-how-the-communist-party-opposes-the-universe_3946.html\">dunce caps<\/a>. That\u2019s what it\u2019s intended for,\u201d he explained, referring to the <a href=\"https:\/\/www.theepochtimes.com\/commentary-4-on-how-the-communist-party-opposes-the-universe_3946.html\">public humiliation method<\/a> forced upon victims of China\u2019s Cultural Revolution of 1966 to 1976.<\/p>\n<p>House Democrats, joined by 10 Republicans, voted on Jan. 13 to approve a single <a href=\"https:\/\/degette.house.gov\/sites\/degette.house.gov\/files\/Impeachment%20Resolution.pdf\">article of impeachment (pdf)<\/a> against Trump for \u201cincitement of insurrection,\u201d making him the first president to be impeached twice. (Leah Millis\/Reuters)<\/p>\n<p>Democrats allege that the president incited violence at the Capitol in a speech he delivered near the White House on Jan 6. In his address, Trump used the words \u201cfight like hell\u201d in reference to his team\u2019s legal efforts around election integrity. The Democrats allege that Trump used the words to incite his followers to commit violence.<\/p>\n<p>Hanson suggested that one of the main drivers of the impeachment effort against Trump is to ensure that he can no longer run for office in the future.<\/p>\n<p>\u201c[It] is sort of a mercenary effort to make sure Donald Trump can\u2019t run again for office because the Constitution says that if a person is successfully impeached, then he\u2019s ineligible for higher office. (Mandel Ngan\/AFP via Getty Images)<\/p>\n<p>In the 78-page trial memorandum, the attorneys posit that the Senate taking up the impeachment amounts to a bill of attainder,\u00a0which the Constitution prohibits because it would amount to inflicting punishment without a jury trial. The defense also contends that the \u201cincitement\u201d accusation is contradicted by the plain text of the transcript of the president\u2019s Jan. 6 speech.<\/p>\n<p>\u201cThe Article of Impeachment presented by the House is unconstitutional for a variety of reasons, any of which alone would be grounds for immediate dismissal. Taken together, they demonstrate conclusively that indulging House Democrats\u2019 hunger for this political theater is a danger to our Republic democracy and the rights that we hold dear,\u201d the <a href=\"https:\/\/beta.documentcloud.org\/documents\/20475074-trump-impeachment-trial-memo\">trial memo<\/a>, authored by Bruce Castor, David Schoen, and Michael van der Veen, states.<\/p>\n<p>The impeachment trial is set to begin with a <a href=\"https:\/\/www.theepochtimes.com\/trump-pleased-with-bipartisan-deal-on-impeachment-trial-structure_3689937.html\">four-hour debate<\/a> on whether the proceedings should be dismissed.<\/p>\n<p>Following Tuesday\u2019s debate, <a href=\"https:\/\/www.theepochtimes.com\/schumer-announces-bipartisan-agreement-on-rules-for-impeachment-trial_3689998.html\">each side will have up to 16 hours to present<\/a> their cases\u00a0starting Wednesday at 12 p.m. ET. Then there will be a total of four hours for senators to question both sides.
