For example, immigrant rights attorney Matt Adams argued that the bond hearings for these immigrants are a \u201cbedrock principle in our legal system.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cIt\u2019s a bedrock principle in our legal system that where the government seeks to lock up a human being for a prolonged period, that person is entitled to a hearing before an independent decision-maker to determine whether the detention is justified,\u201d Adams&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.latimes.com\/politics\/story\/2022-01-11\/biden-administration-urges-supreme-court-to-deny-bond-hearings-for-immigrants-facing-deportation\" target=\"_blank\" rel=\"noopener\">argued<\/a>&nbsp;in court.<\/p>\n<p>The American Civil Liberties Union (ACLU)&nbsp;<a class=\"editor-rtfLink\" href=\"http:\/\/systemic\/\" target=\"_blank\" rel=\"noopener\">claimed<\/a>&nbsp;the Biden administration engaged in a \u201csystemic attack on immigrants\u2019 rights.\u201d<\/p>\n<p>Last week, the administration&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/lccrsf.org\/wp-content\/uploads\/2022\/01\/29-Motion-to-dismiss-and-transfer-venue.pdf\" target=\"_blank\" rel=\"noopener\">asked<\/a>&nbsp;a court to dismiss a case against the federal government brought by families who were separated at the southern border. Biden\u2019s lawyers&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/lccrsf.org\/wp-content\/uploads\/2022\/01\/29-Motion-to-dismiss-and-transfer-venue.pdf\" target=\"_blank\" rel=\"noopener\">argued<\/a>&nbsp;that the separated families could not sue the federal government for monetary damages in this circumstance because it has sovereign immunity from lawsuits brought under the Federal Tort Claims Act.<\/p>\n<div id=\"attachment_19321698\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/01\/GettyImages-1358515999.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-19321698\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/01\/GettyImages-1358515999.jpg\" alt=\"John Moore\/Getty Images\" width=\"640\" height=\"480\" \/><\/a><\/p>\n<p class=\"wp-caption-text\">An immigrant family from Haiti walks towards a gap in the U.S. border wall from Mexico on December 11, 2021, in Yuma, Arizona. (Photo by John Moore\/Getty Images)<\/p>\n<\/div>\n<p>Unsurprisingly, progressives were upset with the Biden administration\u2019s attempt to get the separated families lawsuit tossed out.<\/p>\n<p>\u201cActions speak louder than words, and by sending its lawyers to try to throw separated families out of court, the Biden Administration is effectively defending Trump\u2019s cruel and unlawful family separation policy,\u201d&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.davisvanguard.org\/2022\/01\/biden-administration-betrayal-seeks-to-dismiss-federal-suit-by-families-separated-at-border-under-trump\/\" target=\"_blank\" rel=\"noopener\">said<\/a>&nbsp;Bree Bernwanger, senior immigrant justice attorney at the Lawyers\u2019 Committee for Civil Rights of the San Francisco Bay Area.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>At the same time, the Biden administration is in ongoing litigation involving the Migrant Protection Protocols (MPP), a Trump-era immigration policy often referred to as the \u201cRemain in Mexico\u201d program. Under the Remain in Mexico&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.americanimmigrationcouncil.org\/research\/migrant-protection-protocols\" target=\"_blank\" rel=\"noopener\">policy<\/a>, asylum seekers at the southern border are given notices to appear in immigration court and then sent back to Mexico.<\/p>\n<p>Progressives were appalled with President Biden after the Supreme Court ordered the administration to reimplement the MPP in August.<\/p>\n<p>\u201cThe Biden administration has had nearly two months to issue a new memo that addresses the district court\u2019s concerns and formally terminate the MPP program for good,\u201d&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.americanimmigrationcouncil.org\/news\/reimplementation-mpp-betrayal-president-biden%E2%80%99s-campaign-promises\" target=\"_blank\" rel=\"noopener\">said<\/a>&nbsp;Jorge Loweree, policy director at the American Immigration Council:<\/p>\n<blockquote>\n<p>The fact that it has not done so and is instead moving forward with plans to restart the program in November is a betrayal of the president\u2019s campaign promises and a clear sign that this administration is failing to reenvision border management and the way that we treat people who are seeking protection in the United States.<\/p>\n<\/blockquote>\n<p>The Biden administration began sending migrants back to Mexico under the reimplemented MPP in December 2021.<\/p>\n<p>The cases are&nbsp;<em>Johnson v. Gonzalez<\/em>, No. <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/20-322.html\">20-322<\/a>&nbsp;in the Supreme Court of the United States;&nbsp;<em>Biden v. Texas<\/em>, No. <a class=\"x5l\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/082021zr_ap6b.pdf\" target=\"_blank\" rel=\"noopener external\">21A21<\/a> in the Supreme Court of the United States; and <em>Wilburg P.G v.
