But fast forward some months later, the AG\u2019s report found that regardless of Ms. Boylan\u2019s \u201cpolitical or other personal motivation for making her allegations public, we find that the factual allegations she has made are credible and are supported by the rest of the evidence in our investigation.<\/em><\/p>\n<p>\u201cThey weren\u2019t,\u201d Glavin said bluntly. \u201cThe report credits Ms. Boylan\u2019s claim that on a plane in 2017 the Governor asked Ms. Boylan to play strip poker. And they credit it on the ground that Howard Zemsky, the former head of the Empire State Development Board, had testified that he recalled the Governor making such a statement. So because of that, the AG credited Ms. Boylan.\u201d<\/p>\n<p>\u201cYet the report at the same time says that Mr. Zemsky initially didn\u2019t have the slightest inkling or memory that the governor made any such comment,\u201d Glavin asserted. \u201cBut after Ms. Boylan first made this claim \u2014 it was in a February 24, 2021, Medium essay \u2014 that same day Mr. Zemsky signed on to a public statement with three other Chamber staffers who were on that flight with Lindsey Boylan, and what they said publicly is that \u2018This conversation did not happen.\u2019 That is what Howard Zemsky said February 24, 2021.\u201d<\/p>\n<p>\u201cBut here\u2019s what the report didn\u2019t tell you: Later that same day, February 24, Boylan sent a threatening message to Howard Zemsky,\u201d Glavin declared. \u201cWhat the report put in is they said at some point after the Medium essay Zemsky received a threatening message, a jarring message, but they didn\u2019t tell you it was the same day. And they never told you what that message was, and there is no excuse for that because it goes directly to the credibility of Ms. Boylan; it goes directly to the credibility of Mr. Zemsky.\u201d<\/p>\n<p>\u201cWe now know what Ms. Boylan sent to Mr. Zemsky,\u201d Glavinb continued. \u201cShe sent to Howard Zemsky on a(sic) application, it\u2019s a phone application and it\u2019s called Confide. That application is encrypted; when you send a message through it, it self-destructs and the messages are screenshot-proof. Using that application, Ms. Boylan said to Howard Zemsky that same day, because he was disputing her, \u2018I can\u2019t wait to destroy your life, your s*** follower.\u2019 \u2026 And I presume Ms. Boylan is referring to herself and knowing something about Mr. Zemsky.\u201d<\/p>\n<p>\u201cThe Attorney General\u2019s investigators never asked Lindsey Boylan about that text,\u201d Glavin stated. \u201cThey interviewed Howard Zemsky in July of 2021; they didn\u2019t circle back and say to Ms. Boylan, \u2018Why did you have a Confide application? Why did you send him a text that was encrypted, self-destructing and that he couldn\u2019t take a screenshot of?\u2019\u201d<\/p>\n<p>\u201cWhen you said, \u2018I can\u2019t wait to destroy your life,\u2019 Ms. Boylan, what did you mean? What did you have on Howard Zemsky that you could destroy his life?\u201d<\/p>\n<p>\u201cAnd then after he got that text, he changed his story,\u201d Glavin said.<\/p>\n<p><a href=\"https:\/\/nypost.com\/2022\/01\/13\/cuomo-lawyer-levies-accusations-of-her-own-against-alleged-victim-lindsey-boylan\/\">The New York Post<\/a> reported:<\/p>\n<p><em>Glavin later said that \u201cthere had been some rumors and concerns about their relationship within ESD\u201d sparked by employees \u201chaving witnessed some conduct that gave them concern.\u201d Then-ESD counsel Alphonso David \u201chad them both in and questioned them, and they both denied having ever had some type of improper relationship,\u201d Glavin said. But when Boylan and Zemsky were questioned by James\u2019 investigators, she said, \u201cmy read of the testimony is that they\u2019re not consistent with each other.\u201d<\/em><\/p>\n<p>Boylan\u2019s attorney, Julie Gerchik, responded to Glavin\u2019s claims, saying, \u201cThe former governor and his attorney are continuing their smear campaign of Ms. Boylan to punish her for being the first of multiple women to expose the governor\u2019s misconduct.
