DeSantis\u2019 comments came on \u201cRuthless,\u201d while discussing the High Court\u2019s decision on Thursday against the private sector mandate for employers with 100 or more employees.<\/p>\n<p>As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-strikes-massive-blow-against-bidens-employer-mandate\">reported<\/a> on Thursday, \u201cThe Supreme Court blocked the Biden administration\u2019s emergency rule that would have forced large employers to vaccinate or regularly test their employees.\u201d<\/p>\n<p>That case was decided 6-3, with conservatives all in agreement, albeit for slightly different reasons:<\/p>\n<p><em>Chief Justice Roberts and Justice Gorsuch suggested the pandemic would best be handled by the states or Congress. Justices Amy Coney Barrett critiqued the broadness of the mandate. Justice Brett Kavanaugh, given the economic and political stakes, posited that the governing statute did not provide clear authority for such a broad mandate.<\/em><\/p>\n<p>Speaking before a live crowd in Florida on Thursday afternoon, DeSantis <a href=\"https:\/\/floridapolitics.com\/archives\/486763-gov-desantis-questions-backbone-of-john-roberts-brett-kavanaugh-after-justices-uphold-health-care-vax-mandate\/\">said<\/a> that decision was a \u201cno-brainer.\u201d<\/p>\n<p>\u201cWe won 6-3 on that, which is good, but honestly, this a no-brainer,\u201d the Florida governor said. \u201cAnybody who\u2019s not a far-left jurist is going to go that way.\u201d<\/p>\n<p>However, the court also ruled Thursday in a 5-4 decision in favor of the Centers for Medicare and Medicaid Services (CMS) vaccine mandate. As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-allows-cms-vaccine-mandate-for-healthcare-workers-to-go-forward\">reported<\/a>, \u201cJustices Brett Kavanaugh, John Roberts, Sonia Sotomayor, Stephen Breyer, and Elena Kagen ruled to uphold the CMS mandate while Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Amy Coney Barrett dissented.\u201d<\/p>\n<p>Regarding that decision, DeSantis was highly critical.<\/p>\n<p>\u201cBut on the medical, the nurse mandate and the doctor mandate, Roberts and Kavanaugh joined with the liberals to allow the nurse mandate,\u201d DeSantis said.<\/p>\n<p>\u201cHere\u2019s what\u2019s going on. Think about how insane this is,\u201d he continued. \u201cNow in Florida, we protected the nurses, so we have people who are working. But in other states, they fired nurses who were not vaccinated. Many of them have natural immunity from prior infection. So they fire them. Now they\u2019re so shorthanded, they\u2019re bringing back nurses who are COVID positive.\u201d<\/p>\n<p>\u201cHonestly, Roberts and Kavanaugh didn\u2019t have a backbone on that decision. That\u2019s the bottom line,\u201d DeSantis added.<\/p>\n<p>DeSantis made similar comments earlier in the day on Thursday at a press conference in Panama City, Florida.
