Ron DeSantis (R) said on Thursday that the Biden administration\u2019s&nbsp;Centers for Medicare &amp; Medicaid Services (CMS) vaccine mandate is utterly \u201cinsane,\u201d reiterating that it defies logic by failing to recognize the reality of natural immunity.<\/p>\n<p>\u201cIf you&nbsp;believe that the Constitution \u2014 like the founding fathers believed \u2014&nbsp;that the Constitution is one of&nbsp;limited and enumerated powers,&nbsp;you cannot authorize the&nbsp;federal government acting \u2026 like a state&nbsp;police power,\u201d he <a href=\"https:\/\/www.youtube.com\/watch?v=UMn8QiZcedk\">said<\/a>, explaining that the vaccine mandates are designed to end run around the Constitutional structure.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cSo, we need&nbsp;the Supreme Court to come&nbsp;through and rule properly&nbsp;on that, and it\u2019s not just the OSHA&nbsp;mandate, and you will have&nbsp;problems in other states that&nbsp;didn\u2019t provide protections like&nbsp;Florida did,\u201d he said prior to the ruling.<\/p>\n<p>\u201cThe medical mandate&nbsp;for the nurses&nbsp;and the&nbsp;doctors \u2026 what they\u2019re&nbsp;trying to do is absolutely&nbsp;insane,\u201d he continued, explaining that&nbsp;Florida has provided protections for healthcare workers.<\/p>\n<p>\u201cSo, nurses were&nbsp;rehired. All these people, many&nbsp;of them have natural immunity \u2026 but there\u2019s a&nbsp;crunch on the staffing because&nbsp;you have obviously a lot more&nbsp;COVID nationwide and then you&nbsp;have staff that get out sick&nbsp;with it,\u201d he continued, further explaining the absurdity of the rule.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cIn other states, they&nbsp;have fired nurses for not&nbsp;having vaxed even though most of&nbsp;them have immunity. So, they&nbsp;fire them but now, they\u2019re&nbsp;short-handed. So what are they&nbsp;doing? They are bringing back&nbsp;on the job vaccinated nurses&nbsp;who are currently COVID-positive,\u201d he said.<\/p>\n<p>\u201cSo, if you\u2019re&nbsp;unvaccinated, naturally immune,&nbsp;and uninfected, you\u2019re \u2014 they&nbsp;fire you, but if you\u2019re COVID-positive and vaxed, which we&nbsp;know most of the people that&nbsp;are COVID-positive now are vaxed, they are going back on&nbsp;the job,\u201d he marveled.<\/p>\n<p>DeSantis said the rule shows that the CMS mandate&nbsp;is \u201cabsolutely insane, especially&nbsp;given the ineffectiveness, you&nbsp;know, of these shots to&nbsp;actually stop transmission&nbsp;between individuals.\u201d<\/p>\n<p>\u201cAnd so, I\u2019m&nbsp;hoping that they will get real&nbsp;on this,\u201d he added.<\/p>\n<p>While the Supreme Court <a href=\"https:\/\/www.breitbart.com\/health\/2022\/01\/13\/supreme-court-rejects-bidens-osha-vaccine-mandate-on-private-employers-upholds-cms-mandate\/\">struck down<\/a> the OSHA mandate 6-3, affecting over 84 million workers, it upheld the CMS mandate 5-4, though they did acknowledge that the&nbsp;CMS mandate exempts healthcare employees who object to the vaccine for religious or medical reasons.<\/p>\n<div class=\"entry-content\">\n<p>The applications are <em>NFIB v. OSHA<\/em>, No. 21A244 at the Supreme Court of the United States, and <em>Biden v.
