His future in the country was decided on the basis he is unvaccinated for coronavirus and may pose a risk to the community.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The <em>Sydney Morning Herald <\/em><a href=\"https:\/\/www.smh.com.au\/sport\/tennis\/novak-djokovic-visa-saga-live-updates-immigration-minister-still-yet-to-make-decision-as-serbian-tennis-star-s-2022-australian-open-campaign-remains-in-limbo-20220114-p59o7i.html\">reports<\/a> Hawke said he made his decision \u201cunder section 133C(3) of the Migration Act\u201d and acted \u201con health and good order grounds, on the basis that it was in the public interest to do so.\u201d He added:<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<section class=\"w8o74 _3DA-V\" data-testid=\"live-article-post\">\n<div class=\"_2bITq\">\n<div class=\"_1665V _2dHq7\" data-testid=\"body-content\">\n<blockquote>\n<p>This decision followed orders by the Federal Circuit and Family Court on 10 January 2022, quashing a prior cancellation decision on procedural fairness grounds. In making this decision, I carefully considered information provided to me by the Department of Home Affairs, the Australian Border Force and Mr Djokovic.<\/p>\n<p>The Morrison Government is firmly committed to protecting Australia\u2019s borders, particularly in relation to the COVID-19 pandemic.<\/p>\n<\/blockquote>\n<\/div>\n<div class=\"_1H_qO\">\n<div class=\"_3iFXT noPrint _39mRS\" data-testid=\"social-share\">\n<p>&nbsp;The <em>Herald<\/em> outlined Djokovic\u2019s legal counsel will seek a fast-tracked hearing by minimising the length of written submissions and verbal evidence.
