Notably, under OSHA\u2019s rule, the burden of the cost of testing would remain on the employee, effectively amounting to a <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/04\/osha-rule-imposes-burdens-on-the-unvaccinated-does-not-require-employers-to-pay-for-any-costs-associated-with-testing\/\">work tax<\/a>. However, the court upheld the&nbsp;Centers for Medicare &amp; Medicaid Services (CMS) vaccine mandate 5-4, although it explicitly&nbsp;acknowledged that the CMS mandate exempts employees who object to the vaccine for religious or medical reasons.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Conservatives celebrated the OSHA ruling, particularly, following the verdict.<\/p>\n<p>Ambassador Ken Blackwell, who is now a senior fellow at the Family Research Council, celebrated the OSHA decision, calling it a \u201cconstitutional smack-down of Biden\u2019s imperial power grab.\u201d He criticized the CMS decision, but added, \u201cMost people who object to the vaccine do so for religious or medical reasons, so the Supreme Court\u2019s affirming that those people are exempt from the CMS mandate is a silver lining here.\u201d<\/p>\n<p>\u201cIt took the Supreme Court to set the record straight for the Biden Administration,\u201d Sen.
