Medicaid Services (CMS) mandate.<\/p>\n<p>The <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a244_hgci.pdf\">decision<\/a> on the OSHA mandate was 6-3; the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a240_d18e.pdf\">decision<\/a> on the CMS mandate was 5-4, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the court\u2019s three Democratic appointees in upholding it.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>As Breitbart News <a href=\"https:\/\/www.breitbart.com\/health\/2022\/01\/08\/supreme-court-skeptical-of-biden-vaccine-mandates\/\">reported<\/a> last week, the Court had appeared skeptical of the mandates during oral arguments, especially the OSHA mandate, as Solicitor General Elizabeth Prelogar struggled to identify the statutory authority for imposing it.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Chief Justice Roberts had seemed particularly irritated by a comment by MSNBC anchor Stephanie Ruhle that had been retweeted by White House Chief of Staff Ron Klain, which referred to the OSHA mandate as a \u201c<a href=\"https:\/\/www.dailymail.co.uk\/news\/article-9976957\/Republicans-furious-White-House-Chief-Staff-retweets-post-calling-vaccine-mandate-workaround.html\">workaround<\/a>.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">OSHA doing this vaxx mandate as an emergency workplace safety rule is the ultimate work-around for the Federal govt to require vaccinations.<\/p>\n<p>\u2014 Stephanie Ruhle (@SRuhle) <a href=\"https:\/\/twitter.com\/SRuhle\/status\/1436063357958823940?ref_src=twsrc%5Etfw\">September 9, 2021<\/a><\/p>\n<\/blockquote>\n<p>The conservative justices seemed concerned during oral arguments about the CMS mandate\u2019s use of the federal spending power to pressure institutions accepting Medicare and Medicare funding to comply, but the more limited scope of the mandate, at least compared to the OSHA mandate\u2019s more blatant intrusion into the private sector, appeared to save it.<\/p>\n<p>The oral arguments were also noteworthy for the many false statements made by the justices about the coronavirus pandemic, notably&nbsp;Justice Sonia Sotomayor\u2019s <a href=\"https:\/\/www.breitbart.com\/health\/2022\/01\/07\/fact-check-sotomayor-claims-100000-children-in-serious-condition-on-ventilators\/\">claim<\/a> that 100,000 children were hospitalized.<\/p>\n<p><em>Joel B.
