The first policy is a vaccine-or-testing rule for private business with 100+ employees. The second policy is a vaccine mandate for any health care worker operating out of a facility that receives Medicaid and Medicare funding, minus those who <a href=\"https:\/\/dailycaller.com\/2021\/12\/13\/supreme-court-vaccine-mandate-religious-exemption\/\">qualify<\/a> for religious and medical exemptions.<\/p>\n<p>While the policies were announced in November, enforcement has not yet begun due to lawsuits. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/15\/vaccine-mandates-osha-joe-biden-businesses\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Companies, Business Groups Have Plans To Push Back On Biden\u2019s Vaccine Mandate)<\/a><\/strong><\/p>\n<p>The Supreme Court blocked Biden\u2019s private business <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a244_hgci.pdf\">rule<\/a> 6-3, noting the secretary of labor doesn\u2019t have the \u201cauthority to impose the mandate.\u201d The court added that Congress should have decided the rules.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">BREAKING: The Supreme Court BLOCKS the federal government\u2019s COVID-19 vaccine-or-test requirement for large workplaces. The court ALLOWS a vaccine mandate for workers at federally funded health care facilities to take effect nationwide.<\/p>\n<p>\u2014 SCOTUSblog (@SCOTUSblog) <a href=\"https:\/\/twitter.com\/SCOTUSblog\/status\/1481710289125089283?ref_src=twsrc%5Etfw\">January 13, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cAlthough Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,\u201d the Supreme Court wrote in its opinion, adding that requiring vaccinations for the roughly 84 million Americans this would affect \u201cfalls in the latter category.\u201d<\/p>\n<p>Biden first announced this rule in September and the Occupational Safety and Health Administration [OSHA] issued rules on it in November. The United States Court of Appeals for the Fifth Circuit issued a <a href=\"https:\/\/dailycaller.com\/2021\/11\/06\/fifth-circuit-federal-court-temporarily-blocks-bidens-vaccine-mandate\/\">temporary<\/a> halt of this OSHA rule Nov. 6., and the halt was upheld by the <a href=\"https:\/\/dailycaller.com\/2021\/11\/12\/appeals-court-joe-biden-vaccine-mandate\/\">court<\/a> Nov. 12. The Sixth Circuit Court of Appeals subsequently overturned the ruling in December. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/15\/vaccine-mandates-osha-joe-biden-businesses\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Companies, Business Groups Have Plans To Push Back On Biden\u2019s Vaccine Mandate)<\/a><\/strong><\/p>\n<p>In a narrower, decision, the Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a240_d18e.pdf\">ruled<\/a> 5-4 to allow Biden\u2019s <a href=\"https:\/\/dailycaller.com\/2021\/10\/15\/joe-biden-supreme-court-commission-divided-packing-court\/\">rule<\/a> for healthcare <a href=\"https:\/\/dailycaller.com\/2021\/12\/13\/supreme-court-vaccine-mandate-religious-exemption\/\">workers<\/a> take effect across the country.
