John Kennedy\u2019s question during a <span class=\"style-scope yt-formatted-string\" dir=\"auto\">Senate Judiciary Committee hearing Wednesday.<\/span><\/p>\n<p>Kennedy pressed Jessica Clarke, President Joe Biden\u2019s nominee for the U.S. District Judge for the Southern District of New York, about a Securities and Exchange Commission (SEC) rule, <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/CFR-2021-title17-vol4\/xml\/CFR-2021-title17-vol4-sec240-10b-5.xml\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 10b-5<\/a>. However, Clarke failed to directly answer Kennedy\u2019s question on the rule\u2019s definition.<\/p>\n<p>\u201cThat\u2019s a rule that deals with fraud. I have not litigated a securities matter. If I were to confront one, I would thoroughly research Second Circuit and Supreme Court precedent, and I would apply the law to the facts,\u201d Clarke responded. <strong><a href=\"https:\/\/dailycaller.com\/2021\/12\/17\/john-kennedy-grills-anne-traum-judicial-court-nomination\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: John Kennedy Asks Biden Nominee Anne Traum The Same Question 9 Times In A Row)<\/a><\/strong><\/p>\n<p>Kennedy paused for a moment before challenging Clarke on her response.<\/p>\n<p>\u201cMs. Clarke, you\u2019ve been nominated to the Southern District of New York. That\u2019s where most of our securities cases are litigated. And SEC Rule 10b-5 is about as basic as you can get. You want to take another crack at that and tell me what Rule 10-b5 does?\u201d<\/p>\n<p><strong>WATCH:<\/strong><\/p>\n[embedded content]\n<p>\u201cThank you again for the question, Senator. I regularly confront new issues of law in my practice, and when I do I thoroughly research the issue,\u201d Clarke clarified but had her response cut short by Sen. Kennedy\u2019s interjection.<\/p>\n<p>\u201cI know you\u2019re going to thoroughly research it, but are you telling me today that you don\u2019t know what Rule 10b-5 is?\u201d Kennedy rebutted.<\/p>\n<p>\u201cI only have that basic understanding,\u201d Clarke stated in response.<\/p>\n<p>The <a href=\"https:\/\/www.justice.gov\/usao-sdny\" target=\"_blank\" rel=\"noopener noreferrer\">Southern District of New York<\/a> (SDNY) encompasses the boroughs of Manhattan and the Bronx in New York City, along with Dutchess, Orange, Putnam, Rockland, Sullivan and Westchester counties. The SDNY prosecutes criminal and civil matters of terrorism, white-collar and cybercrime and mortgage fraud, among others, according to the Justice Department. Cases litigated range from large affirmative civil fraud cases encompassed by Rule 10b-5, to cases in health care and bankruptcy.<\/p>\n<p>Clarke has served as chief of the Civil Rights Bureau at the New York State Office of Attorney General since 2019, and previously worked as Of Counsel&nbsp;at the boutique litigation firm <a href=\"https:\/\/ecbawm.com\/our-people\/\" target=\"_blank\" rel=\"noopener noreferrer\">Emery Celli Brinckerhoff Abady Ward &amp; Maazel LLP<\/a> from 2018 to 2019, according to President Biden\u2019s Eleventh Round of Judicial<span class=\"dewidow\">&nbsp;<\/span>Nominees <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/12\/15\/president-biden-names-eleventh-round-of-judicial-nominees\/\" target=\"_blank\" rel=\"noopener noreferrer\">announcement<\/a> from Dec. 15.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Biden judicial nominee appeared to muff her response to Republican Louisiana Sen.
