The testing requirement, which is not yet in effect, results in what essentially amounts to a work tax, as OSHA places the burden of the cost of testing on the employee.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>As Breitbart News<a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/04\/osha-rule-imposes-burdens-on-the-unvaccinated-does-not-require-employers-to-pay-for-any-costs-associated-with-testing\/\"> reported,<\/a>&nbsp;\u201cEmployees who refuse to get the shot will be subject to a coronavirus test \u2018at least weekly\u2019 if they are in an office at least once a week, or \u2018within 7 days before returning to work\u2019 if away from the office for over a week. Notably, the ETS does not place the burden of testing costs on the employer, but on the unvaccinated individual. However, OSHA says employers may be required to pay some of the costs of testing because of other laws or bargaining agreements. Nonetheless, the agency itself is not requiring employers to do so. \u2026<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cAdditionally, the rule requires employers to force unvaccinated individuals to wear a face covering in virtually all scenarios \u2014 when indoors or \u2018when occupying a vehicle with another person for work purposes, except in certain limited circumstances.&#8217;\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.news4jax.com\/news\/local\/2022\/01\/10\/mask-mandate-goes-into-effect-for-unvaccinated-workers-monday\/\">News4Jax<\/a>, \u201cthe&nbsp;masking requirement for unvaccinated workers is the only portion of the law taking effect\u201d on Monday, as the vaccine and testing requirements are \u201con hold until Feb. 9.\u201d<\/p>\n<p>The fate of the mandates currently rests with the Supreme Court, which heard arguments regarding Biden\u2019s&nbsp;large employer vaccine mandate and the rule for healthcare providers on Friday.<\/p>\n<p>\u201cThe government is trying to work across the waterfront, and is just going agency by agency,\u201d Chief Justice John Roberts, who is largely considered a swing vote, <a href=\"https:\/\/www.breitbart.com\/health\/2022\/01\/08\/supreme-court-skeptical-of-biden-vaccine-mandates\/\">said<\/a> of the challenge.<\/p>\n<p>\u201cIt seems to me that the more and more mandates that pop up in different agencies, I wonder if it\u2019s not fair for us at the court to look at a general exercise of power by the federal government,\u201d Roberts said, adding that the court should \u201cthen ask, \u2018Well, why doesn\u2019t Congress have a say in this?
