Trump has said that he did not issue any calls for violence during the Capitol incident. In his speech on Jan. 6, Trump called on supporters to \u201cpeacefully and patriotically\u201d make their voices heard during the joint session of Congress, when lawmakers convened to consider electoral votes cast for the presidential candidates.<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-3684140\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/02\/Trump-clapping-1200x675-1.jpg\" alt=\"Donald Trump greets the crowd\" width=\"640\" height=\"360\" \/><\/p>\n<p>Then-President Donald Trump greets the crowd at the \u201cStop The Steal\u201d rally in Washington on Jan. 6, 2021. (Tasos Katopodis\/Getty Images)<\/p>\n<p>Both Republican and Democratic lawmakers have publicly stated that they want a speedy trial, as the Senate cannot move forward with its legislative priorities until the trial is complete. Many Republicans have decried the trial as a partisan exercise that will lead nowhere. Last month, during a procedural vote, 45 Republican senators voted against holding the trial, suggesting that the former president will not be convicted, as the Senate requires 67 votes for a conviction.<\/p>\n<p>Trump\u2019s lawyers have said they will argue that the impeachment trial is unconstitutional because Trump no longer holds office and will say that his speech was protected under the First Amendment. Trump\u2019s impeachment trial will be the first of a U.S. president no longer in office.<\/p>\n<p>Attorney David Schoen and Bruce Castor, a former district attorney in Pennsylvania, are heading up Trump\u2019s legal defense team.<\/p>\n<p>Harvard Law School professor emeritus Alan Dershowitz said on Feb. 6\u00a0that an effective legal defense is based on challenging the constitutionality of the allegations against Trump.<\/p>\n<p>\u201cThe best arguments he can make, and his lawyers will make, are the constitutional ones, namely the Senate has no jurisdiction over a former president, and the speech was covered by the First Amendment,\u201d Dershowitz told\u00a0<a href=\"https:\/\/www.newsmax.com\/newsfront\/alan-dershowitz-trial-perjury-trap-constitution\/2021\/02\/06\/id\/1008898\/\" target=\"_blank\" rel=\"noopener\">Newsmax<\/a>.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"lazy size-large wp-image-3674209\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"capitol\" width=\"640\" height=\"427\" data-src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/02\/capitol-clash-1200x800-1.jpg\" \/><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-3674209\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/02\/capitol-clash-1200x800-1.jpg\" alt=\"capitol\" width=\"640\" height=\"427\" \/><\/p>\n<p>Protesters clash with police at the U.S. Capitol in Washington on Jan. 6, 2021. Jamie Raskin (D-Md.), the lead House impeachment manager,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/democrats-ask-trump-to-testify-at-impeachment-trial_3685228.html\" target=\"_blank\" rel=\"noopener\">asked Trump<\/a>\u00a0in a Feb. 4 letter to testify in person, with\u00a0Trump\u2019s legal team\u00a0<a href=\"https:\/\/www.theepochtimes.com\/trump-lawyers-dismiss-request-for-former-president-to-testify-during-impeachment-trial_3685470.html\" target=\"_blank\" rel=\"noopener\">rejecting<\/a>\u00a0Raskin\u2019s request, describing it as a \u201cpublic relations stunt.\u201d<\/p>\n<p>\u201cThere is no such thing as negative inference in this unconstitutional proceeding,\u201d Schoen wrote to Raskin. \u201cYour letter only confirms what is known to everyone: you cannot prove your allegations against the 45th president of the United States, who is now a private citizen.\u201d<\/p>\n<p>According to a tally by The Epoch Times, 35 Republican senators have suggested or committed to voting to acquit Trump in trial. Unless Democrats can sway 17 of the 50 Republicans in the upper chamber, Trump will be acquitted.<\/p>\n<p>\u201cThe trial is already over. They don\u2019t have the votes to convict,\u201d Sen. Rand Paul (R-Ky.) told reporters on Thursday. \u201cThis is just, I think, continuing to embitter the public. It\u2019s divisive, and it does nothing to promote unity. I think it\u2019s a big mistake on the Democrats\u2019 part.\u201d<\/p>\n<p>If Trump were to be convicted, the Senate could hold a subsequent vote to bar him from ever holding office again.
