Kelly ruled that the federal government\u2019s decision to cancel Djokovic\u2019s visa following his arrival in Australia was \u201cunreasonable.\u201d<\/p>\n<p>Djokovic\u2019s attempt at a tenth Australian Open title is still in doubt, however, after lawyers for the federal government said they may cancel his visa a second time.<\/p>\n<p class=\"Text__text___3eVx1j Text__dark-grey___AS2I_p Text__regular___Bh17t- Text__large___1i0u1F Body__base___25kqPt Body__large_body___3g04wK ArticleBody__element___3UrnEs\" data-testid=\"paragraph-2\">\u201cLawyers for the federal government, however, indicated the fight may not be over, telling the court that Immigration Minister Alex Hawke was reserving the right to exercise his personal power to again revoke Djokovic\u2019s visa,\u201d according to <a href=\"https:\/\/www.reuters.com\/lifestyle\/sports\/novak-djokovics-bid-stay-australia-goes-before-courts-2022-01-09\/\">Reuters<\/a>.<\/p>\n<p class=\"Text__text___3eVx1j Text__dark-grey___AS2I_p Text__regular___Bh17t- Text__large___1i0u1F Body__base___25kqPt Body__large_body___3g04wK ArticleBody__element___3UrnEs\" data-testid=\"paragraph-3\">If his visa is revoked a second time, Djokovic would be barred from entering the country for a period of three years.<\/p>\n<p>For the past several days, Djokovic has been held at a Melbourne, Australia, hotel used as a detention facility to house asylum seekers and refugees.&nbsp;<\/p>\n<p>The nine-time winner of the Australian Open, had his visa canceled on Thursday by Australian authorities after he \u201cfailed to provide appropriate evidence to meet the entry requirements to Australia.\u201d<\/p>\n<p>Djokovic arrived in Australia on Wednesday in order to participate in the 2022 Australian Open, and after a lengthy standoff with Australian officials, was told that he would not be allowed into the country. Djokovic\u2019s medical exemption from the COVID-19 vaccine \u2014 which was granted by Tennis Australia and the Victorian government on Tuesday \u2014 was the reason for the standoff.<\/p>\n<p>The Victorian government is a state-level authority.<\/p>\n<p>\u201cThe visa for Novak Djokovic has been cancelled,\u201d Australian Minister for Health Greg Hunt <a href=\"https:\/\/www.dailywire.com\/news\/novak-djokovic-denied-entry-into-australia-visa-canceled\">said<\/a> Wednesday. \u201cObviously, that follows a review of the exemption which was provided by the Victorian government process. They were looking at the integrity and the evidence behind it.\u201d<\/p>\n<p>\u201cIt\u2019s a matter to him whether he wishes to appeal that, but if a visa is canceled, someone will have to leave the country,\u201d Hunt continued.<\/p>\n<p>Djokovic\u2019s lawyers challenged the decision by Australian authorities, and it emerged over the weekend that Djokovic was granted the medical exemption due to recovering from COVID-19 in December 2021.&nbsp;<\/p>\n<p>\u201cMr Djokovic had received, on 30 December 2021, a letter from the Chief Medical Officer of Tennis Australia recording that he had been provided with a \u2018Medical exemption from COVID vaccination\u2019 on the grounds that he had recently recovered from COVID,\u201d according to documents <a href=\"https:\/\/www.cnn.com\/2022\/01\/08\/tennis\/novak-djokovic-covid-australia-intl-spt\/index.html\">published<\/a> by the Australia\u2019s Federal Circuit Court show on Saturday.&nbsp;<\/p>\n<p>The case quickly became worldwide news, with both of Djokovic\u2019s parents speaking out on the situation after having conversations with their son. The president of Serbia \u2014 Djokovic\u2019s home country \u2014 also spoke out in support of the tennis star, <a href=\"https:\/\/sports.ndtv.com\/tennis\/serbian-president-aleksandar-vucic-denounces-political-witch-hunt-of-novak-djokovic-in-australian-open-row-over-vaccine-exemption-2693622\">calling<\/a> it a \u201cpolitical witch hunt.\u201d<\/p>\n<p>\u201cI feel terrible since yesterday, the last 24 hours that they are keeping him as a prisoner. It\u2019s just not fair. It\u2019s not human,\u201d Djokovic\u2019s mother, Dijana, <a href=\"https:\/\/twitter.com\/Reuters\/status\/1479145740093902848?s=20\">said<\/a> during a press conference.<\/p>\n<p>\u201cTerrible accommodation,\u201d she continued. \u201cIt\u2019s just some small immigration hotel, if it\u2019s a hotel at all\u2026.It\u2019s so dirty and the food is so terrible. They don\u2019t want to give him any chance to move on to some better hotel or a house that he already rented. But we hope he will manage somehow.\u201d<\/p>\n<p>Djokovic\u2019s father \u2014 Srdjan Djokovic \u2014 said that his son has become the \u201csymbol and the leader of the free world.\u201d<\/p>\n<p>\u201cMy son is tonight in Australian captivity, but he has never been more free,\u201d he said per <a href=\"https:\/\/www.theage.com.au\/sport\/tennis\/it-s-the-only-way-to-stop-this-pandemic-nadal-backs-the-rules-that-stopped-djokovic-20220106-p59m96.html\">The Age<\/a>. \u201cFrom this moment, Novak has become the symbol and the leader of the free world, the world of the poor and disadvantaged nations and peoples.\u201d<\/p>\n<p>\u201cMy son Novak Djokovic has shown that a small, but heroic country like Serbia, can have the best tennis player and sportsman of all time and that truth can no longer be hidden,\u201d he continued.<\/p>\n<p>Srdjan went on to rip the \u201cgreedy and arrogant members of the world\u2019s oligarchy.\u201d<\/p>\n<p>The news of Djokovic\u2019s medical exemption sparked outrage in Australia, a country that has seen severe COVID-19 lockdowns over the past year.<\/p>\n<p>\u201cWhile the Victorian government and Tennis Australia may permit a non-vaccinated player to compete in the Australian Open, it is the Commonwealth government that will enforce our requirements at the Australian border,\u201d Home Affairs Minister Karen Andrews <a href=\"https:\/\/www.espn.com\/tennis\/story\/_\/id\/32997513\/novak-djokovic-needs-prove-exemption-go-home-australian-pm\">said<\/a>. \u201cIf an arriving individual is not vaccinated, they must provide acceptable proof that they cannot be vaccinated for medical reasons to be able to access the same travel arrangement as fully vaccinated travelers.\u201d<\/p>\n<p>The Australian Open begins January 16 and runs through January 31.<\/p>\n<p>Joe Morgan is the Sports Reporter for The Daily Wire.
