Officials say that the NRA is financially solvent and the court filings are meant to ease the move. The bankruptcy, however, is not without risks. The court could appoint a trustee with the power to displace the current board and leadership of the NRA, including longtime CEO Wayne&nbsp;<\/span><span data-contrast=\"auto\">LaPierre<\/span><span data-contrast=\"auto\">. The court-appointed official would enjoy broad power during bankruptcy proceedings. He would be&nbsp;required to act in the best interests of the group&#8217;s creditors and could pursue claims that&nbsp;NRA leaders misused millions of dollars of the group&#8217;s money on their own personal expenses.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">&#8220;It&#8217;s in everybody&#8217;s best interest to get a trustee in there, certainly from the creditors&#8217; point of view, a<\/span><span data-contrast=\"auto\">nd, I would argue, even for the five million members because every dime that they waste in frivolous litigation is a dime less that could go to the core mission,&#8221;&nbsp;Dell&#8217;Aquila said.<\/span> <span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">The group&#8217;s top lawyer, William Brewer, dismissed the idea of a bankruptcy trustee&nbsp;<\/span><span data-contrast=\"none\">in<\/span> <a href=\"https:\/\/freebeacon.com\/courts\/inside-the-nras-strategy-to-escape-disaster\/\"><span data-contrast=\"none\">January<\/span><\/a><span data-contrast=\"auto\">. He said&nbsp;the NRA has responded to accusations of improper spending by filing suit against a top vendor. It has also required leaders such as&nbsp;<\/span><span data-contrast=\"auto\">LaPierre<\/span><span data-contrast=\"auto\">&nbsp;to&nbsp;<\/span><a href=\"https:\/\/www.washingtonpost.com\/politics\/nra-irs-disclosure-990\/2020\/11\/25\/50521108-2d34-11eb-9c71-ccf2c0b8d571_story.html\"><span data-contrast=\"none\">pay back<\/span><\/a><span data-contrast=\"auto\">&nbsp;hundreds of thousands of dollars stemming from reimbursements.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">Dell&#8217;Aquila, who has given six-figures to the group in the past, was <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2021\/02\/Dkt_105_Official-UCC-Appointment.pdf\">placed on<\/a> the unsecured creditors&#8217; committee on Thursday by the bankruptcy court. Brewer said the NRA would fully cooperate with the court and the committee despite being unhappy with Dell&#8217;Aquila&#8217;s appointment.<\/span><\/p>\n<p>&#8220;The NRA is disappointed that a disgruntled individual who has filed frivolous claims against the Association is appointed to the committee,&#8221; Brewer told the <em>Free Beacon<\/em>.<\/p>\n<p><span data-contrast=\"auto\">Dell&#8217;Aquila sees the attempt to move from New York to Texas as a &#8220;fraudulent&#8221; scheme designed to dodge accountability for tens-of-millions spent on luxury suits, private flights, and lavish vacations for NRA executives and their family members.<\/span><\/p>\n<p><span data-contrast=\"auto\">&#8220;The NRA is saying we cleaned up our act. You haven&#8217;t cleaned up your act,&#8221; Dell&#8217;Aquila said. &#8220;You can&#8217;t say, \u2018Well, Wayne [LaPierre] paid back some money and that&#8217;s been resolved and it&nbsp;<\/span><span data-contrast=\"auto\">ain&#8217;t<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">gonna<\/span><span data-contrast=\"auto\">&nbsp;be an issue.&#8217; They say the board has&nbsp;done their job and due diligence<em>\u2014<\/em>the board hasn&#8217;t.&#8221;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">Dell&#8217;Aquila&#8217;s<\/span><span data-contrast=\"auto\">&nbsp;suit, filed on behalf of any NRA members defrauded by the claimed impropriety,&nbsp;<\/span><a href=\"https:\/\/97f2dfb1-8ab2-4a3d-8743-0599df5821e6.filesusr.com\/ugd\/91713c_240027dd53ea475bbad9d6e94ada3ac0.pdf\"><span data-contrast=\"none\">faced a setback<\/span><\/a><span data-contrast=\"auto\">&nbsp;in 2020 when a judge dismissed some of its claims<\/span><span data-contrast=\"auto\">.&nbsp;Elliott Schuchardt,&nbsp;<\/span><span data-contrast=\"auto\">Dell&#8217;Aquila&#8217;s<\/span><span data-contrast=\"auto\">&nbsp;lawyer, said&nbsp;the remaining claim against the NRA is worth $64 million\u2014potentially making them the largest of the group&#8217;s creditors.
