In Utah, \u2018Latinx ethnicity\u2019 counts for more points than \u2018congestive heart failure\u2019 in a patient\u2019s \u2018COVID-19 risk score\u2019\u2014the state\u2019s framework for allocating monoclonal antibodies. And in Minnesota, health officials have devised their own \u2018ethical framework\u2019 that prioritizes black 18-year-olds over white 64-year-olds\u2014even though the latter are at much higher risk of severe disease,\u201d the Free Beacon reported.<\/p>\n<p>The racial discrimination stems from the FDA\u2019s guidance when authorizing monoclonal antibodies and oral antivirals for emergency use. The FDA only authorized these treatments for \u201chigh risk\u201d patients, and included race as a factor determining someone to be \u201chigh risk.\u201d As the Free Beacon noted:<\/p>\n<p><em>The&nbsp;<a href=\"https:\/\/www.fda.gov\/media\/149534\/download\">FDA \u201cfact sheet\u201d for Sotrovimab<\/a>, the only monoclonal antibody effective against the Omicron variant, states that \u201crace or ethnicity\u201d can \u201cplace individual patients at high risk for progression to severe COVID-19.\u201d The&nbsp;<a href=\"https:\/\/www.fda.gov\/media\/155050\/download\">fact sheet for Paxlovid<\/a>, Pfizer\u2019s new antiviral pill, uses the Centers for Disease Control and Prevention\u2019s definition of \u201chigh risk,\u201d which states that \u201csystemic health and social inequities\u201d have put minorities \u201cat increased risk of getting sick and dying from COVID-19.\u201d<\/em><\/p>\n<p>Even though the guidance is nonbinding, several states have used them to justify extremely harmful race-based triage, to the detriment of those at a higher risk of dying from COVID-19.<\/p>\n<p>Minnesota, for example, explicitly cites the FDA as the reason it is discriminating against higher-risk white people in favor of lower-risk minorities.<\/p>\n<p>\u201cThe FDA has acknowledged that in addition to certain underlying health conditions, race and ethnicity \u2018may also place individual patients at high risk for progression to severe COVID-19,\u2019\u201d Minnesota\u2019s racial triage plan states. \u201cFDA\u2019s acknowledgment means that race and ethnicity alone, apart from other underlying health conditions, may be considered in determining eligibility for [monoclonal antibodies].\u201d<\/p>\n<p>Utah justifies the race-based triage similarly, stating that the FDA \u201cspecifically states that race and ethnicity may be considered when identifying patients most likely to benefit from this lifesaving treatment.\u201d<\/p>\n<p>Further, as The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/ny-department-of-health-prioritizes-people-of-color-for-oral-covid-19-therapies\">reported<\/a>, New York\u2019s triage stated that \u201cNon-white race or Hispanic\/Latino ethnicity should be considered a risk factor, as longstanding systemic health and social inequities have contributed to an increased risk of severe illness and death from COVID-19.\u201d<\/p>\n<p>The FDA says race may be considered, but it never said to make race the priority when determining who should get treatment.<\/p>\n<p>Unsurprisingly, even though men are 60% more likely to die from COVID-19 than women \u2013 according to <a href=\"https:\/\/www.brookings.edu\/blog\/up-front\/2021\/10\/19\/at-least-65000-more-men-than-women-have-died-from-covid-19-in-the-us\/\">research<\/a> from the Brookings Institution \u2013 sex is not included as a risk factor in the FDA guidance, though Utah does give men an additional point.<\/p>\n<p>As the Free Beacon noted, the triage in Minnesota and Utah gives members of the BIPOC community two points when determining risk, whereas comorbidities like \u201chypertension in a patient 55 years and older\u201d is only worth one point.
