Commisso is one of eleven women who brought forward allegations of sexual harassment against Cuomo. However, her allegations are unique in that they are the first to result in a criminal charge against the former governor.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Last month, district attorneys in&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.cnn.com\/2021\/12\/23\/politics\/andrew-cuomo-sexual-misconduct-nassau-county\/index.html\" target=\"_blank\" rel=\"noopener\">Nassau<\/a>&nbsp;and&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/nypost.com\/2021\/12\/28\/cuomo-wont-be-charged-for-kissing-women-in-westchester-da\/\" target=\"_blank\" rel=\"noopener\">Westchester<\/a>&nbsp;counties declined to prosecute Cuomo over allegations found in New York Attorney General Letitia James\u2019s&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/2021.08.03_nyag_-_investigative_report.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a>&nbsp;on Cuomo\u2019s alleged sexual harassment. However, the&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.cnn.com\/2021\/12\/02\/politics\/andrew-cuomo-federal-investigation\/index.html\" target=\"_blank\" rel=\"noopener\">federal government<\/a>&nbsp;is reportedly looking into the allegations against Cuomo.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Cuomo resigned from office last August after the findings of James\u2019 report were published.<\/p>\n<p>Albany City Court Judge Holly Trexle&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.axios.com\/andrew-cuomo-sex-crime-charge-8a7dcafc-d53a-4825-9441-108d95b3538a.html\" target=\"_blank\" rel=\"noopener\">dismissed<\/a>&nbsp;and sealed the case against Cuomo. Trexle\u2019s decision comes days after Albany County District Attorney David Soares said Commisso\u2019s allegations against Cuomo were \u201ccredible,\u201d but would not meet the requisite burden of proof at trial.<\/p>\n<p>\u201cWhile we found the complainant in this case cooperative and credible, after review of all the available evidence we have concluded that we cannot meet our burden at trial,\u201d Soares&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/nypost.com\/2022\/01\/06\/andrew-cuomo-sex-crime-case-ex-gov-set-for-virtual-court-appearance\/\" target=\"_blank\" rel=\"noopener\">said<\/a>&nbsp;Tuesday.<\/p>\n<p>Commisso criticized Soares\u2019s decision after it was announced,&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/nypost.com\/2022\/01\/06\/andrew-cuomo-sex-crime-case-ex-gov-set-for-virtual-court-appearance\/\" target=\"_blank\" rel=\"noopener\">saying<\/a>, \u201cI don\u2019t think that it\u2019s teaching anyone anything.
