Ted Cruz has introduced a bill on Tuesday that would allow states to directly purchase COVID-19 treatments such as monoclonal antibodies instead of through the federal government as states seek to bypass the Biden administration\u2019s distribution restrictions.<\/p>\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/3440\/text?r=84&amp;s=2\" target=\"_blank\" rel=\"noopener\">bill<\/a>, S3440, would amend the Defense Production Act of 1950 and the Food, Drug, and Cosmetic Act to allow states to use federal funds to purchase supplies related to COVID-19. The legislation would also prohibit the federal government from \u201cprioritizing Federal contracts over State contracts relating to purchasing supplies to combat the COVID\u201319 pandemic.\u201d<\/p>\n<p class=\"speakable\">\u201cFor months, many of us have been sounding the alarm over the Biden administration\u2019s federal takeover of monoclonal antibody treatment distribution,\u201d Cruz said in a Wednesday statement to Fox News.<\/p>\n<p>\u201cThe bill I\u2019ve introduced would empower states to determine their own needs, so those now facing critical shortages because of the Biden administration\u2019s misguided policy can ensure their citizens are able to get the care they need. The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/gov-abbott-bypasses-biden-on-lifesaving-antibody-care-obtains-doses-for-texas-outside-of-ration\" target=\"_blank\" rel=\"noopener\">reported<\/a> in September:<\/p>\n<p><em>Texas Governor Greg Abbott (R) announced Monday that he has obtained doses of lifesaving antibody treatment on his own, bypassing President Joe Biden\u2019s move to take control of the care and ration doses as he sees fit\u2026<\/em><\/p>\n<p><em>Austin Bureau chief for The Dallas Morning News Bob Garrett detailed, \u201c[Gov. Greg Abbott] says Texas has obtained its own supply of Regeneron, despite roadblocks from Biden administration, from drug wholesaler AmerisourceBergen. State purchasing directly, Abbott tells [Dana Loesch].&nbsp;\u2018Consider this treatment,\u2019 he tells people testing + for&nbsp;<a class=\"css-4rbku5 css-18t94o4 css-901oao css-16my406 r-1n1174f r-1loqt21 r-poiln3 r-bcqeeo r-qvutc0\" role=\"link\" href=\"https:\/\/twitter.com\/hashtag\/COVID19?src=hashtag_click\">#COVID19<\/a>.\u201d<\/em><\/p>\n<p>Florida Republican Gov. The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/florida-surgeon-general-biden-admin-actively-preventing-the-effective-distribution-of-monoclonal-antibody-treatments-in-u-s\" target=\"_blank\" rel=\"noopener\">reported<\/a>:<\/p>\n<p><em>Florida Surgeon General Joseph A. Ladopo sent a searing letter to the Biden administration\u2019s Secretary of Health and Human Services, Xavier Becerra, accusing the Biden administration of \u201cactively preventing the effective distribution of monoclonal antibody treatments in the U.S.\u201d<\/em><\/p>\n<p><em>Ladopo pointed out that in August, Florida GOP governor Ron DeSantis had \u201cannounced a rapid increase in the availability of monoclonal antibody therapy treatments across the state,\u201d adding, \u201cIn a matter of weeks, the state had 25 monoclonal antibody sites up and running \u2013 leading the nation in widespread early COVID-19 treatment availability.\u201d<\/em><\/p>\n<p><em>\u201cBy mid-September, the State of Florida provided this life-saving treatment to nearly 100,000 patients,\u201d he continued. \u201cThese sites served 5,000 patients a day at the peak and nearly 30,000 per week.
