Jay Inslee announced plans Thursday to introduce legislation that would regulate candidates and elected officials from spreading lies about elections that are likely to result in violence.<\/p>\n<p>The legislation, which is still being written and has yet to be released, would be \u201cnarrowly tailored\u201d to cover \u201cfalse statements\u201d made for the \u201cpurpose of undermining the election process or results,\u201d according to Inslee\u2019s <a href=\"https:\/\/www.governor.wa.gov\/news-media\/inslee-statement-efforts-stop-violence-fueled-election-lies\">announcement<\/a>.<\/p>\n<p>\u201cThis legislation attempts to follow the relevant U.S. and state supreme court opinions on this issue. We\u2019re talking about candidates and elected officers knowingly throwing bombs at democracy itself when doing so is likely to result in violence,\u201d Inslee said in a statement. <strong><a href=\"https:\/\/dailycaller.com\/2021\/12\/30\/california-new-york-social-media-laws-facebook-misinformation\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Democrat-Run States Are Pushing Laws To Target Social Media \u2018Misinformation\u2019)<\/a><\/strong><\/p>\n<p>The Democrat announced the planned proposal on the first anniversary of the Jan. 6 <a href=\"https:\/\/dailycaller.com\/2021\/01\/07\/washington-dc-protest-riot-donald-trump-capitol-breach-photos\/\">Capitol riot<\/a>, and he cited the event, as well as statements made by elected officials casting doubt on the results of the 2020 presidential election, as justification for the new speech restrictions.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Today I\u2019m announcing my support for legislation currently being written that would outlaw attempts by candidates and elected officials to spread lies about free and fair elections when it has the likelihood to stoke violence.<\/p>\n<p>My full statement here: <a href=\"https:\/\/t.co\/CC5T0yqzWk\">https:\/\/t.co\/CC5T0yqzWk<\/a><\/p>\n<p>\u2014 Governor Jay Inslee (@GovInslee) <a href=\"https:\/\/twitter.com\/GovInslee\/status\/1479235883286941699?ref_src=twsrc%5Etfw\">January 6, 2022<\/a> <\/p>\n<\/blockquote>\n<p>\u201cJanuary 6 is a reminder not only of the insurrection that happened one year ago, but that there is an ongoing coup attempt by candidates and elected officials to overturn our democracy,\u201d Inslee said. \u201cThey are willing to do this by provoking violence, and today I proposed we do something about that in Washington.\u201d<\/p>\n<p>Recognizing that his law may be unconstitutional as many false statements are protected under the First Amendment, Inslee cited a 1969 Supreme Court <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/395\/444\/\"><u>case<\/u><\/a>, Brandenburg v. Ohio, in which the court ruled that speech \u201cinciting or producing imminent lawless action and is likely to incite or produce such action\u201d is not protected.<\/p>\n<p>\u201cWe can outlaw actions that provoke political violence and in doing so also protect our democracy.
