And as long as I am your commander-in-chief, I will not tolerate efforts to compel receipt of a COVID-19 vaccine. To the extent the DoD vaccine mandate conflicts with the order I have given, my&nbsp;order controls,\u201d Abbot continued.<\/p>\n<p>Abbott then spoke in grave terms about the Biden administration\u2019s mandate and the difficulties it poses to Guardsmen who refuse to comply. \u201cWhile I refuse to be commandeered into doing the federal government\u2019s work,\u201d Abbot wrote, \u201cPresident Biden still poses a career-ending threat to Texas\u2019s unvaccinated guardsmen.\u201d He addressed those provisions in the Defense Department\u2019s mandate which allow the DOD to <a href=\"https:\/\/www.dailywire.com\/news\/defense-secretary-unvaccinated-national-guard-members-cannot-train-be-paid\">prohibit Guardsmen<\/a> from participating in federally-required training and drills, which would deprive them of pay, retirement benefits, and potentially cause them to be dismissed from the Guard.<\/p>\n<p>\u201cLet me be crystal clear: It is the federal government that has put Texas\u2019s guardsmen in this difficult position,\u201d Abbot asserted. \u201cAs your commander-in-chief, I will fight on your behalf. That is why I am suing the Biden Administration over its latest unconstitutional vaccine mandate.\u201d<\/p>\n<p>Abbott did concede the possibility that he would lose, as well as the possibility that President Joe Biden could federalize the National Guard, thus compelling the entire National Guard to get vaccinated under a direct order. \u201cThe federal courts have the power to decide whether President Biden violates the U.S. Constitution\u2019s Second Militia Clause by undermining my commander-in-chief power,\u201d Abbott wrote. \u201cI cannot guarantee that the judiciary will grant the relief you deserve. And if President Biden lawfully calls you into the actual service of the United States, then he could order you to receive the COVID-19 vaccine&nbsp;in his newfound role as your commander-in-chief.\u201d<\/p>\n<p>\u201cWin or lose, President Biden must be held accountable for his unconscionable willingness to hollow out the Texas National Guard\u201d Abbott concluded, promising that he would continue to fight on behalf of his National Guardsmen.<\/p>\n<p>Abbott\u2019s lawsuit comes just weeks after a failed effort by Oklahoma Governor Kevin Stitt to <a href=\"https:\/\/www.dailywire.com\/news\/federal-judge-denies-oklahomas-attempt-to-block-national-guard-vaccine-mandate\">block the vaccine mandate<\/a> for National Guard members. That lawsuit, which argued some of the same points that Abbott outlined in his letter, was dismissed by a federal judge last week.<\/p>\n<p><em>The Daily Wire is fighting Joe Biden\u2019s vaccine mandate in federal court.
