In <a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2022\/01\/Navy-SEALs-PI-Order-.pdf\">the decision<\/a>, Judge Reed O\u2019Connor,&nbsp;U.S. District Court Judge for the Northern District of Texas, ruled that the coronavirus pandemic \u201cprovides the government no license to abrogate\u201d the First Amendment rights of America\u2019s servicemen and women.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cOur nation asks the men and women in our military to serve, suffer, and sacrifice. But we do not ask them to lay aside their citizenry and give up the very rights they have sworn to protect,\u201d the judge wrote.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Members of the U.S. military are expressing their grave concerns as the Pentagon issues a coronavirus vaccine mandate. <a href=\"https:\/\/t.co\/Vvc3xQV3j8\">https:\/\/t.co\/Vvc3xQV3j8<\/a><\/p>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/1432064562862465031?ref_src=twsrc%5Etfw\">August 29, 2021<\/a><\/p>\n<\/blockquote>\n<p>While the judge acknowledged that the military provides members a pathway to a religious exemption for vaccines, he dismissed this as mere \u201ctheater,\u201d noting that no serious weight or attention is given to religious exemptions as they are to secular exemptions, such as potential allergic reactions.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote>\n<p>The mandate treats comparable secular activity (e.g., medical exemptions) more favorably than religious activity. First, the Navy has granted&nbsp;<i>only&nbsp;<\/i>secular exemptions\u2014it has never granted a religious exemption from the vaccine. Second, even if the Navy were to grant a religious exemption, that exemption would still receive less favorable treatment than its secular counterparts. Those who receive religious exemptions are medically disqualified. Those who receive medical exemptions are not. But the activity itself\u2014forgoing the vaccine\u2014is identical. Given the irrationality of the mandate, \u201c[i]t is unsurprising that such litigants are entitled to relief.\u201d<\/p>\n<\/blockquote>\n<p>Describing the pathway to religious exemption as a \u201cf<span dir=\"ltr\">ifty<\/span><span dir=\"ltr\">\u2013<\/span><span dir=\"ltr\">step&nbsp;<\/span><span dir=\"ltr\">process <\/span><span dir=\"ltr\">to <\/span><span dir=\"ltr\">adjudicate <\/span><span dir=\"ltr\">religious <\/span><span dir=\"ltr\">accommodation <\/span><span dir=\"ltr\">requests,\u201d the judge argued that requests are essentially denied before \u201cthe moment they begin.\u201d&nbsp;<\/span><\/p>\n<blockquote>\n<p><span dir=\"ltr\">The first fifteen steps require an adminis<\/span><span dir=\"ltr\">trator to update a <\/span> <span dir=\"ltr\">prepared&nbsp;<\/span><span dir=\"ltr\">disapproval template<\/span> <span dir=\"ltr\">with the requester\u2019s name and rank. In essence, the Plaintiffs\u2019 requests are&nbsp;<\/span>denied the moment they begin. That prepared letter is then sent to seven offices for review. After&nbsp;<span dir=\"ltr\">those offices review the disapp<\/span><span dir=\"ltr\">roval letter, the administrator packages the letter with other&nbsp;<\/span>religious accommodation requests for final signature. The administrator then prepares an internal&nbsp;<span dir=\"ltr\">memo to Vice Admiral John Nowell, asking him to \u201csign .<\/span> <span dir=\"ltr\">.<\/span> <span dir=\"ltr\">. letters <\/span><span dir=\"ltr\">disapproving<\/span> <span dir=\"ltr\">immunization&nbsp;<\/span><span dir=\"ltr\">w<\/span><span dir=\"ltr\">aiver requests based on sincerely held religious beliefs.\u201d<\/span><\/p>\n<p><span dir=\"ltr\">Then, at step thirty-five of the process, the administrator is told\u2014for the first time\u2014to read through the religious accommodation request. At that point, the disapproval letter has already been written, the religious accommodation request and related documents has already been reviewed by several offices, the disapproval has already been packaged with similar requests, and an internal memo has already been drafted requesting that Vice Admiral Nowell disapprove the religious accommodation request.<\/span><\/p>\n<\/blockquote>\n<p>Acknowledging the bias against religious freedoms, the judge determined that the Biden administration failed to show a compelling interest in forcing service members to violate their \u201csincerely held religious beliefs\u201d in accordance with the&nbsp;Religious Freedom Restoration Act (RFRA).<\/p>\n<p>\u201cWithout individualized assessment, the Navy cannot demonstrate a compelling interest in vaccinating these particular Plaintiffs,\u201d the judge argued. \u201cEven if Defendants have a broad compelling interest in widespread vaccination of its force, they have achieved this goal without the participation of the thirty-five Plaintiffs here.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Nah, we&#8217;re good. <a href=\"https:\/\/t.co\/vKcNMtSXY2\">https:\/\/t.co\/vKcNMtSXY2<\/a><\/p>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/1463230948745658373?ref_src=twsrc%5Etfw\">November 23, 2021<\/a><\/p>\n<\/blockquote>\n<p>\u201cSeveral Plaintiffs have tested positive for antibodies, showing the presence of natural immunity. With a 99.4% vaccination rate, the Navy\u2019s herd immunity is at an all-time high,\u201d he continued. \u201cCOVID-19 treatments are becoming increasingly effective at reducing hospitalization and death.\u201d<\/p>\n<p>The case is&nbsp;<i>U.S. NAVY Seals 1-26 v. Biden<\/i>, No. 4:21-cv-1236 in the U.S. District Court for the Northern District of Texas.
