Andrew Cuomo days before he was to be arraigned.\u201d Cuomo was scheduled to be arraigned in Albany City Court on Friday for allegations that he groped Brittany Commisso, his former staffer, in 2020.<\/p>\n<p>Commisso, <a href=\"https:\/\/www.timesunion.com\/state\/article\/District-attorney-expected-to-drop-groping-case-16746980.php?utm_campaign=CMS%20Sharing%20Tools%20(Premium)&amp;utm_source=t.co&amp;utm_medium=referral\">according to the Times-Union<\/a>, wanted to pursue charges against Cuomo, but was told during a meeting with prosecutors Monday afternoon \u201cthat they were planning to invoke their discretion not to move forward, in part, because of the manner in which the criminal complaint had been filed, according to a person briefed on the matter.\u201d<\/p>\n<p>Commisso\u2019s attorney, Brian Premo, said in a statement Tuesday morning that his client \u201chad no control over the filing or prosecution of criminal charges.\u201d<\/p>\n<p>\u201cShe had no authority or voice in those decisions,\u201d Premo said. \u201cThe only thing she has any power over is her resolution to continue to speak the truth and seek justice in an appropriate civil action, which she will do in due course.\u201d<\/p>\n<p>Commisso alleged that Cuomo had pulled her in for a hug but then reached under her blouse and fondled one of her breasts in November 2020.<\/p>\n<p>From the Times-Union:<\/p>\n<p><em>The criminal case involving Commisso\u2019s allegations began on Oct. 28 when a summons charging Cuomo with forcible touching was issued by an Albany City Court judge. The criminal complaint was issued after an investigator with the Albany County Sheriff\u2019s Office went to City Court and presented evidence against Cuomo to a judge, including a sworn affidavit from the investigator.<\/em><\/p>\n<p><em>The summons was issued without the knowledge of the district attorney\u2019s office, which had been conducting a separate investigation of Commisso\u2019s allegations, or the knowledge of Commisso\u2019s attorney. The sheriff\u2019s department had gathered evidence using search warrants \u2014 including electronic records they said supported the woman\u2019s account of her Dec. 7, 2020, visit to the mansion \u2014 while the district attorney\u2019s office had been relying on grand jury subpoenas.<\/em><\/p>\n<p><em>The judge issued a summons against Cuomo a day before members of the sheriff\u2019s and district attorney\u2019s offices were scheduled to meet to evaluate the progress of their respective investigations. That meeting was canceled after the summons was issued.<\/em><\/p>\n<p>This is the latest charge against Cuomo to be dropped. Also on Monday, the Manhattan District Attorney\u2019s office dropped its investigation into Cuomo\u2019s handling of the pandemic and nursing homes.<\/p>\n<p>As the Post reported: \u201cActing Nassau DA Joyce Smith also dropped the criminal case detailing \u2018credible\u2019 and \u2018deeply troubling\u2019 allegations that Cuomo ran his hand across the trooper\u2019s belly at Long Island\u2019s Belmont Park in 2019.\u201d<\/p>\n<p>Finally, Cuomo will also face no sexual misconduct charges in Westchester county after the District Attorney\u2019s office said it had conducted a thorough investigation and found \u201ccredible evidence\u201d that Cuomo had inappropriately touched women, The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/district-attorney-no-charges-against-cuomo-over-sexual-allegations-despite-credible-evidence\">reported<\/a>.<\/p>\n<p>While these state charges were all dropped, the U.S. Department of Justice <a href=\"https:\/\/www.cnbc.com\/2021\/12\/02\/doj-probing-andrew-cuomo-sex-harassment-claims-contract-reveals.html\">is still investigating<\/a> Cuomo for sexual misconduct allegations.<\/p>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
