He ruled that HHS has no authority to issue such a mandate unless Congress gives the agency power to do so. He added that \u201d there is a substantial likelihood that the mandates do not fit within the Head Start Act\u2019s authorizing text, that HHS failed to follow the APA in promulgating the mandates and that the mandates are arbitrary and capricious.\u201d<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>HHS issued new rules last month requiring children two-years-old and above in Head Start programs to wear masks and mandating staff, volunteers, and contractors be vaccinated against coronavirus by the end of January.&nbsp;Head Start is a federal education program that reportedly \u201cpromotes the school readiness of infants, toddlers, and preschool-aged children from low income families,\u201d <a href=\"https:\/\/www.acf.hhs.gov\/ohs\/about\/head-start\">according<\/a> to HHS.<\/p>\n<p>In his opinion, Hendrix also wrote that Biden\u2019s mandates will \u201clikely cause further staff shortages to the existing hiring crisis\u201d and lead to a loss of funding and program closures.<\/p>\n<p>\u201cAs a result, children who have previously received pre-K Head Start services and funding will be prevented from participating in \u201can essential part of preparing children, particularly children living in poverty, for success in school and life.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>For example, Wichita Falls ISD Superintendent Mike Huhrt, whose district receives about $800,000 in funding to serve 393 children from low-income families, said Biden\u2019s mandate could lead to a \u201cdeficiency in the district,\u201d&nbsp;<em>Times Record News&nbsp;<\/em><a href=\"https:\/\/www.timesrecordnews.com\/story\/news\/2021\/12\/18\/joe-biden-head-start-covid-mask-vaccine-orders-under-fire-texas\/8940899002\/\">reported<\/a>.<\/p>\n<p>\u201cIf you have a deficiency in your program, you have a chance of not being funded for the next year,\u201d Huhrt said.<\/p>\n<p><span>Hendrix acknowledged that the public has an interest in reducing the spread of coronavirus and said an outbreak could also lead to program closures.&nbsp;<\/span><\/p>\n<p><span>\u201cBut given the relatively high vaccination rate of staff, the risk of program closures may be greater under the Rule than in its absence,\u201d he concluded.&nbsp;<\/span><\/p>\n<p><span>Texas Attorney General Ken Paxton filed the lawsuit against Becerra on December 10, alleging the mandate could strip Texas programs of&nbsp;<\/span><span>$842 million in federal grants.&nbsp;<\/span><span>The <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/executive-management\/Head%20Start%20Complaint%20Filed.pdf\">complaint<\/a> reads:<\/span><\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote>\n<p><span>The effect on smaller communities in Texas would be devastating. A recent survey found that 86 percent of child care centers are facing staffing shortages. According to the Bureau of Labor Statistics, 166,900 fewer people worked in child care in December 2020 than in December 2019, when the industry employed about 1,040,400 people. In addition, a recent survey determined that four in five child care centers in the U.S. are understaffed.<\/span><\/p>\n<\/blockquote>\n<p><span>Paxton <a href=\"https:\/\/www.foxnews.com\/politics\/texas-federal-injunction-biden-vaccine-mandate\">told<\/a> Fox News the preliminary injunction is a \u201cwin for the children of Texas.\u201d<\/span><\/p>\n<p><span>\u201cWe thought that was a parental choice, not a Joe Biden choice, so we sued them, arguing that he didn\u2019t have the authority \u2013 statutory or constitutional \u2013 to do this,\u201d he continued.&nbsp;<\/span><\/p>\n<p><span>While Hendrix\u2019s ruling only applies to Texas, 24 states <a href=\"https:\/\/agjefflandry.com\/Files\/Article\/12989\/Documents\/HeadStartComplaint.pdf\">joined<\/a> Louisiana in a similar lawsuit filed on December 21 asking the District Court for the Western District of Louisiana to grant a preliminary injunction against Biden\u2019s mask and vaccine mandates for Head Start programs.&nbsp;<\/span><\/p>\n<p><span>The Texas decision is another blow to the Biden administration\u2019s attempt to legislate vaccination \u2014 the Supreme Court is set to hear oral arguments <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/12\/22\/supreme-court-hear-challenges-biden-osha-healthcare-worker-vaccine-mandates\/\">challenging<\/a> its OSHA vaccine mandate for large businesses and CMS mandate for healthcare workers on January 7.&nbsp;<\/span><\/p>\n<p><span>The case is <em>Texas v.
