The Occupational Safety and Health Administration\u2019s (OSHA) recently published Emergency Temporary Standard (ETS), issued November 4, 2021, ignores those limitations.<\/p>\n<\/blockquote>\n<p>On December 22, the Supreme Court made an extraordinarily rare decision to hold oral arguments on January 7 on four emergency applications for stay \u2014&nbsp;<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/122221zr2_f20h.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">two of which<\/a>&nbsp;are being supported by AAF\u2019s <em>amicus<\/em> brief \u2014 filed by several business groups and a majority of states in the nation. The two emergency applications for stay included in AAF\u2019s brief had been filed in response to the U.S. Court of Appeals for the Sixth Circuit\u2019s decision to allow Biden to move forward with his vaccine mandate on private employers while legal challenges are still being litigated.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>In addition to arguments about the two applications challenging the OSHA mandate, the Supreme Court on January 7 will also&nbsp;<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/122221zr1_d18e.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">hear<\/a>&nbsp;arguments over two applications challenging the&nbsp;Centers for Medicare &amp; Medicaid Services (CMS) mandate that 10 million healthcare workers be vaccinated.<\/p>\n<p>The Supreme Court\u2019s December 22 order about the oral arguments is significant in that it marks the first time in many years that the High Court will hold such arguments over emergency applications for temporary stay.<\/p>\n<p>In a statement about AAF\u2019s <em>amicus<\/em> brief, Pence emphasized his stance that the vaccine mandates are a violation of individual freedom.<\/p>\n<p>\u201cAmerica is about freedom and the ability to make the best decision for your family or business, and Joe Biden\u2019s vaccine mandate must be stopped in its tracks in order to preserve freedom, protect American livelihoods and businesses, and to safeguard our Constitution,\u201d Pence said.<\/p>\n<p>He added, \u201cJoe Biden\u2019s vaccine mandate is not the American way, and Advancing American Freedom will always stand up to unconstitutional overreach from the Executive Branch that infringes on the freedoms we so greatly cherish.\u201d<\/p>\n<p>AAF, which Pence launched in April 2021, <a href=\"https:\/\/advancingamericanfreedom.com\/issues\/\" target=\"_blank\" rel=\"noopener\">promotes<\/a> the pro-life movement, school choice, religious liberty, and other conservative principles, and the group has <a href=\"https:\/\/advancingamericanfreedom.com\/advancing-american-freedom-files-amicus-brief-in-religious-freedom-case\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> numerous <em>amicus<\/em> briefs in support of its causes.<\/p>\n<p>The&nbsp;applications are&nbsp;<em>NFIB v. OSHA<\/em>,&nbsp;No. 21A244,&nbsp;and&nbsp;<em>Ohio v.
