The nolle prosequi said both guards had completed community service and complied with terms of an earlier non-prosecution agreement in which the case would not be brought to trial until after an investigation into Epstein\u2019s death with the Justice Department\u2019s Office of the Inspector General was complete, according to the report.<\/p>\n<p>Charges were filed against the duo back in November of 2019, alleging the pair fell asleep and disregarded their duties while on the job, failing to conduct their checks at the Metropolitan Correctional Center where Epstein was being held on sex-trafficking and sexual-abuse charges, according to <a href=\"https:\/\/www.insider.com\/prosecutors-drop-case-against-jeffrey-epstein-jail-guards-2021-12\" target=\"_blank\" rel=\"noopener noreferrer\">Insider<\/a>. The charges also alleged the pair falsified prison records, which both men pleaded guilty to. Epstein was then found dead in his cell on Aug. 10, with a coroner ruling his death <a href=\"https:\/\/dailycaller.com\/2020\/01\/09\/jeffrey-epstein-video-deleted-federal-prosecutors\/\" target=\"_blank\" rel=\"noopener noreferrer\">suicide<\/a>.<\/p>\n<p>Epstein\u2019s <a href=\"https:\/\/dailycaller.com\/2019\/11\/14\/jeffrey-epstein-brother-suicide\/\" target=\"_blank\" rel=\"noopener noreferrer\">brother<\/a> hired a private <a href=\"https:\/\/dailycaller.com\/2019\/11\/07\/jeffrey-epstein-brother-unexplained-injuries\/\" target=\"_blank\" rel=\"noopener noreferrer\">coroner<\/a> who said Epstein\u2019s death appeared to be more consistent with a homicide, according to Insider. <strong><a href=\"https:\/\/dailycaller.com\/2021\/12\/30\/virginia-giuffre-ghislaine-maxwell-did-not-act-alone-prince-andrew-accountability\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Prince Andrew Accuser Pleads For Accountability After Ghislaine Maxwell Verdict: She \u2018Did Not Act Alone\u2019)<\/a><\/strong><\/p>\n<div id=\"attachment_7345249\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7345249\" class=\"wp-caption-text\">NEW YORK, NY \u2013 NOVEMBER 29: People gather to protest human trafficking at the Thurgood Marshall United States Courthouse where the trial of Ghislaine Maxwell is being held on November 29, 2021 in New York City. (David Dee Delgado\/Getty Images)<\/p>\n<\/div>\n<p>Noel\u2019s lawyer Jason Foy said his client is \u201cextremely grateful that we were able to convince the government and the court the termination of criminal prosecution through a deferred prosecution agreement is in the interests of justice,\u201d in a statement obtained by <a href=\"https:\/\/lawandcrime.com\/high-profile\/day-after-ghislaine-maxwells-convictions-prosecutors-formally-ditch-case-against-jeffrey-epsteins-jail-guards\/\" target=\"_blank\" rel=\"noopener noreferrer\">Law and Crime<\/a>.<\/p>\n<p>Thomas\u2019 lawyer Montell Figgins said Thomas \u201cis very happy to put this case behind him,\u201d according to the report.<\/p>\n<p>While prosecutors were dropping charges against the guards, a jury found <a href=\"https:\/\/dailycaller.com\/2021\/12\/29\/ghislaine-maxwell-guilty-verdict-5-6-charges\/\" target=\"_blank\" rel=\"noopener noreferrer\">Maxwell guilty<\/a> on five of the six counts against her.
