Kevin Stitt and the state\u2019s Attorney General John O\u2019Connor, writing that the claims were \u201cwithout merit.\u201d<\/p>\n<p>\u201cThe court is required to decide this case on the basis of federal law, not common sense. But, either way, the result would be the same,\u201d Friot wrote in the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.okwd.116005\/gov.uscourts.okwd.116005.41.0.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a>. \u201cThe claims asserted by the Governor and his co-plaintiffs are without merit.\u201d<\/p>\n<p>On December 2, Stitt filed a lawsuit against the Biden administration to stop the vaccine requirement for National Guard members in his state.<\/p>\n<p>\u201cTherefore, unless mobilized by the President of the United States under U.S. Code Title10, I retain the authority for all training and governance of the Oklahoma National Guard \u2013 including determining if and how training guidelines issued by the president will be implemented,\u201d Stitt said in a&nbsp;<a href=\"https:\/\/oklahoma.gov\/governor\/newsroom\/newsroom\/2021\/december\/governor-stitt--attorney-general-o-connor-sue-biden-administrati.html\" target=\"_blank\" rel=\"noopener\">statement<\/a>.<\/p>\n<p>\u201cThis week, Secretary of Defense Lloyd Austin declared his intention to proceed with unconstitutional punishment that individually targets Oklahoma National Guard soldiers and airmen, including withholding their pay,\u201d the governor added.<\/p>\n<p>In a Twitter post regarding the lawsuit, Stitt wrote, \u201cIt is unconscionable that President Biden is choosing to play politics with military paychecks.\u201d<\/p>\n<p dir=\"ltr\" lang=\"en\">.<a href=\"https:\/\/twitter.com\/Okla_OAG?ref_src=twsrc%5Etfw\">@Okla_OAG<\/a> and I are fighting back against the Biden administration for their unconstitutional National Guard vaccine mandate.<\/p>\n<p>It is unconscionable that President Biden is choosing to play politics with military paychecks.<\/p>\n<p>My full statement:<a href=\"https:\/\/t.co\/c3OCZhPpU8\">https:\/\/t.co\/c3OCZhPpU8<\/a><\/p>\n<p>\u2014 Governor Kevin Stitt (@GovStitt) <a href=\"https:\/\/twitter.com\/GovStitt\/status\/1466540937274966019?ref_src=twsrc%5Etfw\">December 2, 2021<\/a><\/p>\n<p>Stitt has increasingly spoken out against the Biden administration\u2019s mandates in recent weeks. The Daily Wire previously <a href=\"https:\/\/www.dailywire.com\/news\/gop-governors-challenge-dod-to-end-covid-19-vaxx-mandate-for-national-guard\" target=\"_blank\" rel=\"noopener\">reported<\/a>:<\/p>\n<p><em>The&nbsp;<a href=\"https:\/\/governor.iowa.gov\/sites\/default\/files\/documents\/Joint%20Governors%20Letter%20to%20SECDEF%20-%20NG%20Vaccine%20Mandate%2012.14.2021.pdf?utm_medium=email&amp;utm_source=govdelivery\" target=\"_blank\" rel=\"noopener\">letter<\/a>&nbsp;focused on the rights of personnel, arguing that the requirement is beyond the department\u2019s constitutional authority.<\/em><\/p>\n<p><em>\u201cWe acknowledge your right to establish readiness standards for the National Guard for activation into a Title 10 status,\u201d the letter said.<\/em><\/p>\n<p><em>\u201cHowever, directives dictating whether training in a Title 32 status can occur, setting punishment requirements for refusing to be COVID-19 vaccinated, and requiring separation from each state National Guard if unvaccinated are beyond your constitutional and statutory authority,\u201d it added.<\/em><\/p>\n<p><em>Iowa Gov. Kim Reynolds, Wyoming Gov. Mark Gordon, Alaska Gov.&nbsp;Mike Dunleavy, Mississippi Gov.&nbsp;Tate Reeves, and Nebraska Gov.&nbsp;Pete Ricketts were the Republicans included as signers of the letter.<\/em><\/p>\n<p>Earlier in December, Texas Republican Gov.
