She further indicated that she was concerned about the ramifications of denying the Governor\u2019s request and so she said \u201csure.\u201d The Governor then kissed her on the cheek and, as indicated in the Attorney General\u2019s report, \u201csaid something to the effect of, \u2018oh, I\u2019m not supposed to do that\u2019 or \u2018unless that\u2019s against the rules.\u201d\u2018A second woman has alleged (publicly and to our investigators) that Cuomo grabbed her arm, pulled her toward him and kissed her on the cheek without seeking permission for such a greeting while the two were at an event at White Plains High School.<\/p>\n<p>\u201cOur investigation found credible evidence to conclude that the alleged conduct in both instances described above did occur,\u201d Westchester County District Attorney Mimi Rocah said in a statement. \u201cHowever, in both instances, my Office has determined that, although the allegations and witnesses were credible, and the conduct concerning, we cannot pursue criminal charges due to the statutory requirements of the criminal laws of New York. This conclusion is unrelated to any possible civil liability which is beyond the scope of a District Attorney\u2019s jurisdiction, which focuses solely on criminal laws.\u201d<\/p>\n<p>Rocah concluded by championing the \u201cbravery of the women and witnesses who have cooperated with law enforcement,\u201d adding that her office remains \u201ccommitted to supporting them and all survivors.\u201d<\/p>\n<p>Late last week, Nassau County District Attorney Joyce Smith announced she would not prosecute Cuomo following an investigation by her office into allegations that he inappropriately touched a female state trooper in 2019.<\/p>\n<p>\u201cOur exhaustive investigation found the allegations credible, deeply troubling, but not criminal under New York law,\u201d she <a href=\"https:\/\/abc7ny.com\/andrew-cuomo-sexual-harassment-doj-investigation\/11376479\/\">said<\/a>. \u201cIt is important to note that our investigation was limited to alleged conduct at Belmont Racetrack, and prosecutors in other jurisdictions continue to review other allegations of misconduct by Mr. Cuomo.
