Throwing your hands up and saying nothing can be done isn\u2019t sufficient. People\u2019s lives are endangered everyday and nobody\u2019s being held accountable,\u201d said Hoylman.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Legal experts contacted by the&nbsp;<em>New York Post&nbsp;<\/em>argue that Hoylman\u2019s bill is unlikely to stand up in court.<\/p>\n<p>Via the&nbsp;<em><a href=\"https:\/\/nypost.com\/2021\/12\/26\/ny-bill-aims-to-hold-social-media-companies-accountable-for-disinformation\/\">New York Post<\/a>:<\/em><\/p>\n<blockquote>\n<p>\u201cCOVID misinformation, political misinformation, and many other categories of \u2018false\u2019 or harmful information are protected by the First Amendment,\u201d said Eric Goldman, an internet law professor at Santa Clara University School of Law in Silicon Valley.<\/p>\n<p>\u201cThis bill\u2019s attempt to restrict the dissemination of that constitutionally protected content is facially unconstitutional.\u201d<\/p>\n<p>While Hoylman\u2019s bill tries to distinguish between sites allowing users to post certain content and promoting that content by recommending it through features like Instagram\u2019s explore page and YouTube\u2019s recommendations bar, Goldman believes that distinction wouldn\u2019t hold up in court.<\/p>\n<\/blockquote>\n<p>This is another sign that Democrats wish to wield state power to make Big Tech platforms even more censored than they already are. It follows a year of public pressure from the Biden White House against tech companies for hosting so-called misinformation.<\/p>\n<p>In July, a group of 189 House Republicans sent a letter to the Biden administration <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/07\/23\/republicans-demand-answers-white-house-working-facebook\/\">demanding answers on its collusion with tech companies to censor First Amendment protected speech<\/a>.
