It passed both the House and Senate with bipartisan support in December, though it did face some opposition from certain <a href=\"https:\/\/thehill.com\/policy\/defense\/584833-house-passes-768b-defense-policy-bill\">Republican<\/a> and <a href=\"https:\/\/thehill.com\/policy\/defense\/585920-senate-approves-sweeping-defense-bill\">Democratic<\/a> lawmakers.<\/p>\n<p>The NDAA increased spending aimed at helping Ukraine defend itself, countering military expansion in <a href=\"https:\/\/dailycaller.com\/2021\/04\/09\/biden-budget-defense-spending-china-navy\/\">China<\/a> and obtaining more advanced aircraft and ships, according to the NYT. The Biden administration&nbsp;<a href=\"https:\/\/dailycaller.com\/2021\/04\/09\/biden-budget-defense-spending-china-navy\/\">previously<\/a> identified China as a \u201ctop challenge\u201d while making the budget proposal.<\/p>\n<p>\u201cThe discretionary request prioritizes the need to counter the threat from China as the Department\u2019s top challenge. The Department would also seek to deter destabilizing behavior by Russia,\u201d Biden\u2019s budget request, <a href=\"https:\/\/dailycaller.com\/2021\/04\/09\/biden-budget-defense-spending-china-navy\/\">issued<\/a> in April and asking for $715 billion, reads. <strong><a href=\"https:\/\/dailycaller.com\/2021\/05\/28\/biden-budget-request-jobs-families-plan-spending-deficit\/\">(RELATED:&nbsp;Biden Unveils Budget Request For $6 Trillion In Spending, Highest Since World War II)<\/a><\/strong><\/p>\n<p>The agreed-upon NDAA also increases pay for more service members by 2.7% \u2013 a provision that was overwhelmingly bipartisan, even garnering the support of lawmakers who ultimately voted against passing the NDAA in the House.<\/p>\n<p>\u201cThe Act authorizes fiscal year appropriations principally for the Department of Defense, for Department of Energy national security programs, and for the Department of State,\u201d <a href=\"https:\/\/dailycaller.com\/2021\/08\/19\/biden-military-advisers-leaders-intel-withdrawal-afghanistan-abc-stephanopoulos\/\">Biden<\/a> said in a statement on Monday following the bill\u2019s signing. \u201cThe Act provides vital benefits and enhances access to justice for military personnel and their families, and includes critical authorities to support our country\u2019s national defense.\u201d<\/p>\n<div id=\"attachment_7343534\" class=\"wp-caption aligncenter\">\n<p id=\"caption-attachment-7343534\" class=\"wp-caption-text\">WASHINGTON, DC \u2013 DECEMBER 27: U.S. President Joe Biden walks to speak with reporters on the South Lawn before departing from the White House on Marine One on December 27, 2021 in Washington, DC. (Photo by Anna Moneymaker\/Getty Images)<\/p>\n<\/div>\n<p>The president <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/12\/27\/statement-by-the-president-on-s-1605-the-national-defense-authorization-act-for-fiscal-year-2022\/\">criticized<\/a> various <a href=\"https:\/\/dailycaller.com\/2021\/07\/28\/biden-pentagon-defense-budget-cut-troops-civilian-workforce\/\">portions<\/a> of the bill in a statement following its signing. Some were relating to Guantanamo Bay, with Biden calling it unfortunate that one section \u201ccontinues to bar the use of funds to transfer Guantanamo Bay detainees to the custody or effective control of certain foreign countries.\u201d He also called out a second portion of the bill that \u201cbars the use of funds to transfer Guantanamo Bay detainees into the United States unless certain conditions are met.\u201d<\/p>\n<p>\u201cIt is the longstanding position of the executive branch that these provisions unduly impair the ability of the executive branch to determine when and where to prosecute Guantanamo Bay detainees and where to send them upon release,\u201d Biden argued.<\/p>\n<p>Still, the NDAA, which covers the fiscal year 2022, includes some marked changes. One agreement included in the <a href=\"https:\/\/dailycaller.com\/2021\/04\/11\/joe-biden-discretionary-budget-request-2022\/\">bill<\/a> will overhaul how the military handles internal criminal investigations, <a href=\"https:\/\/www.nytimes.com\/2021\/12\/07\/us\/politics\/military-sexual-assault-congress.html\">according<\/a> to the NYT. Now, military commanders will lose much of the previous authority they had to prosecute sexual assault cases, for example. They\u2019ll often be replaced by independent military prosecutors.<\/p>\n<p>In another new move, sexual harassment in the military will now be criminalized under the Uniform Code of Military Justice. Independent investigation will also be required for crimes such as kidnapping and murder. Lawmakers praised the bill as transformative.<\/p>\n<p class=\"css-axufdj evys1bk0\">\u201cThese reforms, which are supported by longstanding advocates for survivors of the sexual assault crisis in the military, will take the prosecution of all sex crimes in the military away from the control of the military commander,\u201d Democratic Washington Rep.
