Trudeau was actually talking about a clause in the Canadian Constitution that he does not agree with.<\/p>\n<p><span><strong>Fact Check:<\/strong><\/span><\/p>\n<p>In the video, Trudeau says: \u201cRegardless of the fact that we are attacking your fundamental rights or limiting your fundamental rights, and the charter says it\u2019s wrong, we are still going to go ahead and do it. It\u2019s basically a loophole that allows a majority to override the fundamental rights of a minority.\u201d<\/p>\n<p>Trudeau\u2019s comments, however, were taken out of context. Through a keyword search, Check Your Fact found that the clip is from an <a href=\"https:\/\/www.nationalnewswatch.com\/2021\/12\/17\/justin-trudeau-shares-fathers-dislike-of-clause-allowing-override-of-charter-rights\/#.YcT8M2jMJPb\">interview<\/a> Trudeau gave on Dec. 16 with The Canadian Press. In a longer clip from the interview posted by <a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-justin-trudeau-shares-fathers-disdain-of-notwithstanding-clause\/\">The Globe and Mail<\/a>, Trudeau follows the comments heard in the Facebook post by saying he disagrees with those sentiments.<\/p>\n<p>\u201cAnd that is why I agree with my father that it is not a great thing to have in a charter of rights and freedoms,\u201d Trudeau stated. <strong><a href=\"https:\/\/checkyourfact.com\/2021\/11\/05\/fact-check-justin-trudeau-kilt-climate-change-cop26\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Does This Image Show Justin Trudeau Wearing A Kilt At The UN\u2019S COP26?)<\/a><\/strong><\/p>\n<p>Trudeau was explaining how the \u201cnotwithstanding clause\u201d in section 33 of the <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/const\/page-12.html#h-51\" target=\"_blank\" rel=\"noopener noreferrer\">Charter of Rights and Freedoms<\/a> could allow provinces to be protected from claims that they have violated rights, according to the interview.<\/p>\n<p>Trudeau\u2019s remarks about the \u201cnotwithstanding clause\u201d were prompted after a teacher in Quebec was reassigned from her classroom because she was wearing a hijab, an act that violates Bill 21, <a href=\"https:\/\/www.theguardian.com\/world\/2021\/dec\/13\/canada-quebec-teacher-removed-classroom-hijab\" target=\"_blank\" rel=\"noopener noreferrer\">The Guardian<\/a> reported. <a href=\"https:\/\/www.washingtonpost.com\/world\/2021\/12\/19\/quebec-bill-21-hijab-fatemeh-anvari\/\" target=\"_blank\" rel=\"noopener noreferrer\">Bill 21<\/a> is a law that forbids public employees from wearing religious garments in Quebec, according to the outlet.<\/p>\n<p>The \u201cnotwithstanding clause\u201d makes it so Bill 21 can\u2019t be challenged as a violation of freedom of religion and expression, the <a href=\"https:\/\/www.washingtonpost.com\/world\/2021\/12\/19\/quebec-bill-21-hijab-fatemeh-anvari\/\">Washington Post<\/a>&nbsp;reported.
