Franco will be deposed in early 2022, the outlet added.<\/p>\n<p>Attorneys for Depp sent a subpoena to Franco \u201cafter May 2016 surveillance video showed him getting into an elevator with Heard 24 hours after they had a blowout fight, during which Heard alleged Depp gave her a black eye,\u201d Page Six reported. \u201cFranco and Heard are seen leaving the elevator together on the penthouse floor, where Depp and Heard had shared an apartment,\u201d the outlet added.<\/p>\n<p>Depp\u2019s legal team reportedly is treating Franco as a \u201cwitness\u201d and wants to know if he and Heard discussed the argument or if Franco saw any bruises on Heard\u2019s face.<\/p>\n<p>Depp alleges he never abused Heard and that she didn\u2019t have any bruises until she showed up in court claiming abuse and seeking a temporary restraining order. Depp alleges in his lawsuit that the bruises were \u201cpainted-on.\u201d<\/p>\n<p>\u201cI have denied Ms. Heard\u2019s allegations vehemently since she first made them in May 2016 \u2026 when she walked into court to obtain a temporary restraining order with painted-on bruises that witnesses and surveillance footage show she did not possess each day of the preceding week. I will continue to deny them for the rest of my life. I never abused Ms. Heard or any other woman,\u201d Depp\u2019s lawsuit says, according to Page Six.<\/p>\n<p>As The Daily Wire previously <a href=\"https:\/\/www.dailywire.com\/news\/judge-refuses-to-dismiss-johnny-depps-libel-lawsuit-against-amber-heard\">reported<\/a> Depp is suing Heard for $50 million in damages over an op-ed Heard wrote in The Washington Post claiming to be the victim of domestic abuse, though she did not name Depp as her abuser.<\/p>\n<p>On three occasions, Courthouse News&nbsp;<a href=\"https:\/\/www.courthousenews.com\/judge-wont-send-johnny-depps-defamation-suit-to-virginia-supreme-court\/\">reported<\/a>, Heard\u2019s attorneys have tried and failed to get the defamation lawsuit dismissed, the most recent loss coming on October 12.<\/p>\n<p>On that day, Judge Penney Azcarate once again refused to dismiss the case. Heard\u2019s attorneys argued that the findings in Depp\u2019s U.K. defamation lawsuit \u2014 which he lost \u2014 should be followed here in the states. In August, Azcarate also&nbsp;<a href=\"https:\/\/www.fairfaxcounty.gov\/circuit\/sites\/circuit\/files\/assets\/documents\/pdf\/opinions\/cl-2019-2911-depp-ii-v-heard-08172021.pdf\">ruled<\/a>&nbsp;against Heard, writing at the time that the facts in the current case were not the same as those in the U.K. In that lawsuit, Depp took issue with Heard and a British tabloid that called him a \u201cwife beater.\u201d<\/p>\n<p>As The Daily Wire previously&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/johnny-depp-loses-libel-case-against-ex-wife-and-british-tabloid-judge-accepts-description-that-hes-a-wife-beater\">reported<\/a>, Depp lost that case, in large part due to the difficulties in proving libel cases. Depp had to prove that he&nbsp;<em>didn\u2019t<\/em>&nbsp;abuse Heard \u2014 essentially he had to prove a negative. And while a judge in the U.K. acknowledged that Depp was able to cast doubt on at least two of Heard\u2019s allegations, he failed to disprove her other 12 allegations.<\/p>\n<p>Depp\u2019s attorneys called the ruling \u201cperverse\u201d and \u201cbewildering,\u201d pointing out the mountain of evidence the judge appeared to have ignored in arriving at his decision.<\/p>\n<p>\u201cMost troubling is the Judge\u2019s reliance on the testimony of Amber Heard, and corresponding disregard of the mountain of counter-evidence from police officers, medical practitioners, her own former assistant, other unchallenged witnesses and an array of documentary evidence which completely undermined the allegations, point by point. All of this was overlooked,\u201d said Depp\u2019s attorney Jenny Afia. \u201cThe judgment is so flawed that it would be ridiculous for Mr. Depp not to appeal this decision.\u201d<\/p>\n<p>Among that \u201cmountain\u201d of evidence, The Daily Wire previously&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/listen-actress-amber-heard-admits-to-hitting-johnny-depp-in-shocking-audio\">reported<\/a>, was surveillance videos, eyewitness statements, audio, photos, and more showing that Depp was the real victim.<\/p>\n<p>\u201cOne of the testimonies comes from Trinity Esparza, who was the concierge at the penthouse where Heard claims Depp hit her in the face. Esparza now questions how Heard received the mark on her face she claimed was from Depp, after reviewing surveillance footage from three days later, when Heard\u2019s sister Whitney pretended to punch her in the face, according to court documents,\u201d The Daily Wire reported.<\/p>\n<p>Further, evidence suggested Heard attacked Depp while the actor was in bed and staged the attacks she claimed he committed.<\/p>\n<p>\u201cUnaware that members of Mr. Depp\u2019s security team (including an 18-year veteran of the Los Angeles County Sheriff\u2019s Department) were mere feet away, Ms. Heard falsely began yelling, \u2018Stop hitting me, Johnny,\u2019\u201d Depp alleged in court documents. \u201cThe interaction culminated with Ms. Heard making false allegations that Mr. Depp struck her with a cell phone, hit her and destroyed the penthouse.
