Trump fully and faithfully executed his duties as the president of the United States and at all times acted to the best of his ability to preserve, protect and defend the Constitution of the United States while never engaging in any high crimes or misdemeanors.\u201d<\/p>\n<p>The Senate requires at least 67 senators to convict a president, while the House only requires a simple majority. House\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-impeachment\" target=\"_blank\" rel=\"noopener\">impeachment<\/a>\u00a0managers released a brief on Tuesday, alleging that Trump\u2019s speech and conduct incited the violence at the Capitol on Jan. 6. Ten Republicans joined all Democrats in impeaching Trump, who was still in office at the time.<\/p>\n<p>\u201cPresident Trump\u2019s conduct must be declared unacceptable in the clearest and most unequivocal terms. This is not a partisan matter. His actions directly threatened the very foundation on which all other political debates and disagreements unfold,\u201d a brief filed by Democratic House impeachment managers stated. \u201cThey also threatened the constitutional system that protects the fundamental freedoms we cherish.\u201d<\/p>\n<p>Last week, 45 GOP senators voted against holding the impeachment trial, with only five Republicans joining Democrats in the upper chamber. At least 17 Republicans would have to join Democrats, which suggests the impeachment trial most likely won\u2019t net a conviction.<\/p>\n<div>\n<div>\n<div id=\"inside_ad_336x280_1\" data-google-query-id=\"CP-J86eizO4CFQLNwAodubgCkg\">\n<div id=\"google_ads_iframe_\/5965368\/EET_article_inside_336x280_0__container__\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Still, Democratic impeachment managers alleged that the former president\u2019s \u201cactions directly threatened the very foundation on which all other political debates and disagreements unfold.\u201d Furthermore, they\u00a0said his conduct \u201crequires\u201d that he be convicted in the Senate and barred from holding office in the future.<\/p>\n<p>Castor and Schoen also argued in their brief that Trump did not make false election claims\u2014as Democrats have alleged\u2014and said state election laws were changed to favor mail-in balloting efforts amid the pandemic.<\/p>\n<p>\u201cInsufficient evidence exists upon which a reasonable jurist could conclude that the 45th President\u2019s statements were accurate or not, and he therefore denies they were false,\u201d they wrote.<\/p>\n<p>In an interview with Fox News\u2019 Sean Hannity, Schoen said the defense would make the case that Trump\u2019s impeachment is unconstitutional, the Capitol riot was in part pre-planned, and that a conviction would be a blow to the First Amendment.<\/p>\n<p>\u201cBesides the fact that this process is completely unconstitutional \u2026 this is a very, very dangerous road to take with respect to the First Amendment, putting at risk any passionate political speaker, which is against everything we believe in this country,\u201d Schoen said.<\/p>\n<p>In his Jan. 6 remarks, Trump \u201ccondemned violence at all times,\u201d Schoen added. \u201cRead the words of his speech.
