DOJ attorney Lisa Sandoval stated that SpaceX \u201cultimately failed to hire him for the position because he is not a U.S. citizen or lawful permanent resident.\u201d<\/p>\n<p>Last Thursday, the DOJ filed a request with a judge \u201cto order SpaceX to comply with an administrative subpoena for documents related to how the company hires,\u201d <a href=\"https:\/\/www.cnbc.com\/2021\/01\/28\/doj-investigating-spacex-after-hiring-discrimination-complaint-.html\">CNBC<\/a> reported. The DOJ wants SpaceX to comply with its subpoena within two weeks.<\/p>\n<p>The disgruntled applicant initially filed a complaint of employee discrimination with the DOJ\u2019s Immigrant and Employee Rights Section (IER) on May 29, 2020. The IER enforces the\u00a0anti-discrimination provision of the Immigration\u00a0and Nationality Act, which has an anti-discrimination provision prohibiting citizenship status\u00a0and national\u00a0origin discrimination in hiring, firing, or recruitment or referral for a fee.<\/p>\n<p>IER emailed SpaceX on June 8 that an investigation was underway and asked SpaceX to hand over information and documents related to its hiring and employment eligibility verification processes. The letter stated, \u201cIER\u2019s investigation is not &#8230;\u00a0limited only to the specific allegations and\/or claims that\u00a0[the Charging Party] made in\u00a0the charge summarized above.\u00a0Our investigation therefore\u00a0may also explore whether [SpaceX] engages in any pattern or\u00a0practice of discrimination\u00a0that 8 U.S.C. \u00a7 1324b prohibits.\u201d<\/p>\n<p>According to the document filed on Thursday, SpaceX responded on August 28, sending the DOJ a Form I-9 spreadsheet, but \u201cSpaceX refused to produce any Form\u00a0I-9 supporting\u00a0documentation, such as copies of employees\u2019 passports, driver\u2019s licenses, or\u00a0Social\u00a0Security cards,\u00a0as requested.\u201d<\/p>\n<p>On October 7, 2020, IER obtained the subpoena from an OCAHO administrative\u00a0law judge; SpaceX received the subpoena on October 12. On October 20, representatives from the DOJ met with SpaceX\u2019s counsel; on October 26, SpaceX filed to either revoke or modify the subpoena, arguing that the subpoena exceeded IER\u2019s authority. On November 1, IER filed its opposition to SpaceX\u2019s action.<\/p>\n<p>On December 1, 2020, OCAHO denied SpaceX\u2019s petition to modify or revoke and ordered SpaceX to comply with the subpoena. On December 11, 2020, SpaceX said it had received \u00a0OCAHO\u2019s order but\u00a0notified IER that it did \u201cnot intend to\u00a0produce any additional information in response to\u00a0the administrative subpoena.\u201d<\/p>\n<p>The DOJ asserted, \u201cThis Court should order SpaceX to comply\u00a0with the Subpoena because, as\u00a0OCAHO ruled: (1) IER has authority to\u00a0investigate SpaceX, (2) IER followed proper\u00a0procedural requirements, (3) the evidence sought by the\u00a0Subpoena\u00a0is directly relevant to IER\u2019s investigation, and (4) the investigation is not unduly burdensome.\u201d<\/p>\n<p>\u201cPetitioner\u2019s failure to establish overbreadth or undue burden also means\u00a0that this Court should not modify the Subpoena, such as\u00a0by requiring IER to accept a\u00a0sampling of the Form I-9 supporting documentation or anything less than what is sought,\u201d the DOJ concluded.<\/p>\n<p><i><span style=\"font-weight: 400\">The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
