Haas, and Assistant Superintendent for School Community Empowerment Bernard Hairston.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cDefendants claim that they want to stand against racism,\u201d the lawsuit states. \u201cBut rather than eliminate racism from the School District, Defendants have done the opposite.\u201d<\/p>\n<p>Ultimately, the plaintiffs say \u201cthe question is whether Defendants may use unconstitutional means to indoctrinate students with an ideology that teaches children to <em>affirmatively discriminate<\/em> based on race.\u201d [Italics in original].<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: We just filed suit against Albemarle County Public Schools, challenging its CRT-inspired indoctrination program that teaches kids to view everything and everyone through the lens of race, fostering division.<\/p>\n<p>\u2014 Alliance Defending Freedom (@ADFLegal) <a href=\"https:\/\/twitter.com\/ADFLegal\/status\/1473790596838010881?ref_src=twsrc%5Etfw\">December 22, 2021<\/a><\/p>\n<\/blockquote>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>As Breitbart News previously <a href=\"https:\/\/www.breitbart.com\/education\/2021\/05\/28\/exclusive-critical-race-theory-inside-virginia-countys-curriculum-racial-indoctrination\/\">reported<\/a>, the county adopted a \u201cradical \u2018anti-racism\u2019&nbsp;<a class=\"x5l\" href=\"https:\/\/www.k12albemarle.org\/our-division\/anti-racism-policy\/policy\" target=\"_blank\" rel=\"noopener external\">policy<\/a>&nbsp;<a href=\"https:\/\/media.breitbart.com\/media\/2021\/05\/Anti-racism-Advisory-Lessons-Overview-and-Resources-for-Adults-working-with-young-people.pdf\">aimed<\/a>&nbsp;at \u2018building the racial consciousness\u2019 by&nbsp;<a class=\"x5l\" href=\"https:\/\/docs.google.com\/document\/d\/1jHdXUJusYZ94dST-kAd1K1uwpCtGGu085_j_hJ9Oi58\/edit\" target=\"_blank\" rel=\"noopener external\">requiring<\/a>&nbsp;children to deconstruct their racial and sexual identities and \u2018understand that anti-racism is an action\u2019 for which they have a \u2018personal responsibility.&#8217;\u201d<\/p>\n<p>That policy, implemented by Haas and Hairston, the plaintiffs claim, is \u201cracist at its core,\u201d and further argue, quoting caselaw, that \u201cthe way to stop discrimination on the basis of race is to stop discriminating on the basis of race.\u201d<\/p>\n<p>But discriminating on the basis of race is exactly what the parents argue is going on in their children\u2019s schools.<\/p>\n<p>Defining the \u201canti-racists\u201d policy explicitly as \u201ccritical race theory\u201d \u2014 in spite of the county\u2019s repeated denials that they use critical race theory, even in the face of a plethora of evidence to the contrary \u2014 the parents argue:<\/p>\n<blockquote>\n<p>Far from exploring ideas or philosophies surrounding justice and reconciliation, that ideology fosters racial division, racial stereotyping, and racial hostility. So does the [anti-racist] Policy.<\/p>\n<\/blockquote>\n<p>The plaintiffs also point out the defendants\u2019 fundamental re-definition of what \u201cracism\u201d means.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>\u201cRacism\u201d is defined as \u201cA system of advantage based on race. The subordination of people of color by white people,\u201d according to the lawsuit. The parents argue:<\/p>\n<blockquote>\n<p>This new understanding [of racism] classifies all individuals into a racial group and identifies them as either perpetually privileged oppressors or perpetually victimized members of the oppressed, denying agency to both. It assumes that racism terminally infects our social institutions, requiring their dismantling.<\/p>\n<\/blockquote>\n<p>Pointing out that the policy does not recognize being \u201cnot racist\u201d as a possible category, the lawsuit says the defendants \u201cimpute[] racism not only to those who consciously discriminate based on race, but also to those of a certain race (white) who do not actively participate in the prescribed dismantling.\u201d<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<p>As Breitbart News previously <a href=\"https:\/\/www.breitbart.com\/education\/2021\/05\/28\/exclusive-critical-race-theory-inside-virginia-countys-curriculum-racial-indoctrination\/\">reported<\/a>, Albemarle County and other CRT adherents believe \u201canti-racism is an action\u201d and a \u201cpersonal responsibility.\u201d CRT teaches that if:<\/p>\n<blockquote>\n<p>\u2026you are white or a part of so-called white \u2018power structures,\u2019 you are inherently racist and part of an oppressing class. By operating under this framework, CRT argues the only way to establish \u2018justice\u2019 is to completely revolutionize society by overthrowing the oppressor\u2019s institutions.<\/p>\n<\/blockquote>\n<p>Indeed, in a video statement, Hairston said:<\/p>\n<blockquote>\n<p>If I identify forms of racism, and I do absolutely nothing about it, then I become a practitioner of racism. Now consider this controversial statement by some researchers, \u2018You are either a racist or an anti-racist.\u2019 It is time for you to think about how you will own this required antiracism training and the policy.<\/p>\n<\/blockquote>\n<p>Quoting the county\u2019s use of critical race theory purveyor Ibram X. Kendi\u2019s <em>How to Be an Antiracist<\/em>, the plaintiffs argue \u201cKendi expressly embraces racist discrimination as the answer to racism,\u201d because he wrote, \u201cThe only remedy to racist discrimination is antiracist discrimination. The only remedy to past discrimination is present discrimination. The only remedy to present discrimination is future discrimination.\u201d<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>Critical race theory is not just embedded in the general policies of the school district, but also heavily in the curriculum.<\/p>\n<p>As Breitbart News <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/06\/03\/albemarle-county-virginia-activists-petition-force-radical-race-gender-curricula-children\/\">reported<\/a>, the district started implementing a critical race theory-based curriculum through a pilot program at Joseph T. Henley Middle School called \u201cCourageous Conversations about Race,\u201d which has since reporting gone through several name-changes.<\/p>\n<p>The lawsuit cites several slides, many of which drive the point that, \u201cabsent of making antiracist choices, we (un)consciously uphold aspects of white supremacy.\u201d The lawsuit says:<\/p>\n<blockquote>\n<p>Defendants also urged certain students to consider their privilege or lack of privilege, and to strive to be \u2018anti-racists.\u2019 Because \u2018[i]n the absence of making antiracist choices, we (un)consciously uphold aspects of white supremacy, white-dominant culture, and unequal institutions and society.\u2019<\/p>\n<\/blockquote>\n<div id=\"attachment_19254762\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/Screenshot-2021-12-24-114303.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-19254762\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/Screenshot-2021-12-24-114303.jpg\" alt=\"Slide of 8th Grade Curriculum. (Screenshot via Lawsuit).<\/p>\n<\/div>\n<p>The lawsuit argues:<\/p>\n<blockquote>\n<p>Far from being objective curricula, however, the pilot program focused squarely on race and identity. It sought to indoctrinate students in racial stereotypes and treated students differently based on race. (Screenshot via Lawsuit).<\/p>\n<\/div>\n<p>\u201cIt speaks of \u2018white people\u2019 as a monolith who gain or lose power by perpetuating a system based on racial discrimination,\u201d the lawsuit says.<\/p>\n<p>Hiring and training practices are also steeped in critical race theory. According to the lawsuit, the defendants \u201calso conducted division-wide training for teachers where they focused on \u2018white privilege.&#8217;\u201d<\/p>\n<p>\u201cThe training explained that white teachers must be pushed to consider \u2018privilege systems, whiteness, [and] race,&#8217;\u201d the plaintiffs wrote, \u201cto realize that the \u2018myth of meritocracy\u2026isn\u2019t true,\u2019 to recognize \u2018systemic white racism,\u2019 and to move from color-blindness to racial consciousness.\u201d<\/p>\n<p>In addition, Hairston stated in the aforementioned video that \u201cstaff needed to think about whether they were on the \u2018anti-racism school bus or if you need help finding your seat and keeping your seat or if it\u2019s time for you to just get off the bus.&#8217;\u201d<\/p>\n<p>Quoting U.S. Supreme Court precedent, the lawsuit says \u201c[g]overnment action dividing us by race is inherently suspect because such classifications promote \u2018notions of racial inferiority and lead to a politics of racial hostility.\u2019\u201d<\/p>\n<p>\u201cOne of the principal reasons race is treated as a forbidden classification,\u201d the argument continues, \u201cis that it demeans the dignity and worth of a person to be judged by ancestry instead of by his or her own merit and essential qualities.\u201d<\/p>\n<p>The plaintiffs also take on directly the use of deceptive language that is standard in the implementation of critical race theory, so as to try not to draw attention to the policy.<\/p>\n<p>Defining \u201cequity\u201d as fundamentally different from \u201cequality,\u201d the lawsuit says \u201cto focus on equity is to direct that <em>different<\/em> races must be treated differently, and unequally, just because of membership in a certain racial category. No other aspect of personhood is relevant.\u201d [Italics in original].<\/p>\n<p>\u201cAnti-racism,\u201d furthermore, \u201cdraws from the poisoned well of racism itself,\u201d they continue.<\/p>\n<p>As Breitbart News has&nbsp;<a href=\"https:\/\/www.breitbart.com\/politics\/2021\/12\/01\/education-department-extends-million-dollar-funding-for-critical-race-theory-training-program\/\">reported<\/a>,&nbsp;given the emergence of critical race theory as a major political issue, institutions that wish to implement it may surreptitiously refer to it by other means, or camouflage it behind phrases like \u201cculturally responsive teaching\u201d \u2014 which uses the same CRT acronym \u2014 \u201cculturally competent,\u201d \u201canti-racist,\u201d and \u201cequity.\u201d<\/p>\n<p>The defendants define an \u201canti-racist\u201d as&nbsp;\u201csomeone who practices identifying, challenging, and changing the values, structures, and behaviors that perpetuate systemic racism\u201d who must overcome their \u201cbias and prejudice\u201d and \u201chelp&nbsp;dismantle structures and practices that intentionally and\/or unintentionally disadvantage <em>historically marginalized people<\/em>,\u201d according to district-provided resource \u201cAm I an Anti-Racist.\u201d<\/p>\n<p>However, the plaintiffs point out that there is only one type of privilege to overcome: \u201cwhite privilege,\u201d which is \u201c[a]n unacknowledged system of favoritism and advantage granted to white people as the beneficiaries of historical conquest.\u201d<\/p>\n<p>In training slides, staff are encouraged to move from a \u201ccolorblind\u201d view to a \u201ccolor conscious\u201d view of race.<\/p>\n<div id=\"attachment_19255130\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/Screenshot-2021-12-24-122523.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-19255130\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/Screenshot-2021-12-24-122523.jpg\" alt=\"Albemarle County race consciousness chart. (Screenshot via Lawsuit).<\/p>\n<\/div>\n<p>As Breitbart News reported, Diversity Teacher Chris Booz told parents the critical race theory ideology \u201cis going to be woven through in all of the classes in Albemarle County.\u201d<\/p>\n<p>The defendants also argue that the policy both chills speech and unlawfully compels speech.<\/p>\n<p>To \u201csquelch student dissent and disagreement,\u201d the plaintiffs say the school board \u201clabeled dissent and disagreement as \u2018racism.&#8217;\u201d In addition, \u201chaving redefined \u2018racism\u2019 to include dissent from and disagreement with their radical agenda, they threaten to discipline students for such supposedly racist acts.\u201d<\/p>\n<p>The disciplinary action appears to have extended to teachers as well. Breitbart News <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/06\/23\/exclusive-school-teacher-ousted-for-helping-expose-critical-race-theory\/\">reported<\/a> a Henley Middle School teacher having been fired for sharing the curriculum with parents.<\/p>\n<p>Quoting Alexandr Solzhenitsyn\u2019s The&nbsp;Gulag Archipelago, the defendants write,&nbsp;\u201c[T]he line separating good and evil passes not through states, nor between classes, nor between political parties either\u2014but right through every human heart\u2014 and through all human hearts.\u201d<\/p>\n<p>The case is <em>C<\/em><i data-stringify-type=\"italic\">.I. v Albemarle County School Board<\/i>, and has not yet been assigned a docket number in the Circuit Court for the County of Albemarle, Virginia.<\/p>\n<p><em>Breccan F.
