President Joe Biden, just hours after his inauguration,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/bidens-halt-to-border-wall-construction-to-cost-about-5000-jobs-billions-of-dollars-former-cbp-commissioner_3674666.html\" target=\"_blank\" rel=\"noopener\">signed an executive order to terminate the emergency declaration<\/a>\u00a0on the southern border and halt border wall construction. The emergency declaration was previously extended by Trump until February 2022.<\/p>\n<p>The order also directs the executive branch to assess \u201cthe legality of the funding and contracting methods used to construct the wall.\u201d<\/p>\n<p>\u201cIt would therefore be appropriate for the Court to hold further proceedings in this case in abeyance to allow for the completion of the process that the President has directed,\u201d\u00a0Prelogar argued (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-138\/167807\/20210201145622795_20-138%20Sierra%20Club%20-%20Motion%20to%20Hold%20in%20Abeyance%20-%20final%20a.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>).<\/p>\n<div>\n<div><\/div>\n<\/div>\n<p>Meanwhile, the\u00a0<a href=\"https:\/\/www.theepochtimes.com\/trump-admin-asks-supreme-court-to-allow-remain-in-mexico-asylum-policy-to-continue_3261265.html\" target=\"_blank\" rel=\"noopener\">case challenging a policy that would send illegal immigrants<\/a>\u00a0entering via the southern border back to Mexico while they wait for a court to process their claims was scheduled for argument on March 1. The Department of Homeland Security (DHS) said on Jan. 20 that it would no longer enroll newly arriving\u00a0<a href=\"https:\/\/www.theepochtimes.com\/t-asylum-seekers\" target=\"_blank\" rel=\"noopener\">asylum seekers<\/a>\u00a0at the southern border into one of Trump\u2019s key immigration policies known as the\u00a0Migrant Protection Protocols (MPP).<\/p>\n<p>The MPP,\u00a0more commonly known as the\u00a0\u201cRemain in Mexico\u201d policy, was enacted in January 2019 in an attempt to curb the flow of\u00a0illegal immigration\u00a0into the United States and prevent fraudulent or nonmeritorious cases. It sends asylum seekers back to Mexico while they wait for their cases to be heard. The policy aims to end loopholes in the current \u201ccatch and release\u201d policy, under which asylum seekers are allowed to remain in the United States as they await a court hearing, in many cases, never to be seen again.<\/p>\n<p>\u201cGiven DHS\u2019s suspension of new enrollments in MPP and its current review of the program, it would be appropriate for the Court to hold further proceedings in this case in abeyance to allow for the completion of that review,\u201d the acting solicitor general wrote (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/19\/19-1212\/167806\/20210201143843402_19-1212%20Innovation%20Law%20Lab%20-%20Motion%20to%20Hold%20in%20Abeyance%20-%20FINAL.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>).<\/p>\n<p>Prelogar noted in both requests that the challengers in the cases agreed with the proposal.<\/p>\n<p>Since taking office, Biden has issued a flurry of executive orders, some of which overturn actions taken by Trump. (AP Photo\/Oscar Rivera)<\/figcaption><\/figure>\n<p>The\u00a0<a href=\"https:\/\/www.theepochtimes.com\/mexico-announces-56-percent-drop-in-illegal-immigrants-arriving-at-us-border-after-crackdown_3072170.html\" target=\"_blank\" rel=\"noopener\">flow of migrants arriving at the southern border has dropped significantly<\/a>\u00a0following the implementation of these stringent measures.<\/p>\n<p>Biden has\u00a0<a href=\"https:\/\/www.theepochtimes.com\/mkt_app\/biden-promptly-dismantles-trumps-border-security-measures_3672234.html\" target=\"_blank\" rel=\"noopener\">also signed orders<\/a>\u00a0to revoke a\u00a0travel ban\u00a0that Trump had placed on terror-prone countries that had consistently failed to provide \u201cterrorist, criminal, or identity information\u201d for their travelers,\u00a0ordered the DHS to continue the\u00a0Deferred Action for Childhood Arrivals, or DACA program, and suspended deportations of illegal aliens for 100 days.<\/p>\n<p>A federal judge has ruled to\u00a0<a href=\"https:\/\/www.theepochtimes.com\/federal-judge-to-extend-order-blocking-biden-administrations-100-day-deportation-pause_3678286.html\" target=\"_blank\" rel=\"noopener\">temporarily block Biden\u2019s order<\/a>\u00a0to suspend the deportations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Biden administration on Monday asked the Supreme Court to cancel oral arguments in two cases separately challenging former President Donald Trump&#8217;s border wall and &#8220;remain in Mexico&#8221; policies.
